PERMANENT WATER MAIN EASEMENT
KNOW ALL MEN BY THESE PRESENTS DRURY INDUSTRIES, INC, a
Nevada Corporation, in consideration of the sum of One Dollar ($100) and other good
and valuable consideration, the receipt of which is hereby acknowledged, do hereby
grant, bargain, sell and convey to the CITY OF CAPE GIRARDEAU, MISSOURI, a
Municipal Corporation, hereinafter called the City, the right, privilege, perixussion and
authority to enter on and upon the following described property which is solely owned
by the undersigned located in the City and County of Cape Girardeau, Missouri, to -wit
A TRACT OF LAND BEING IN THE NORTHWEST (QUARTER OF SECTION 2
IN TOWNSHIP 30 NORTH, RANGE 13 EAST, AS RECORDED IN PLAT BOOK
18 AT PAGE 65, CAPE GIRARDEAU COUNTY RECORDS, CITY OF CAPE
GIRARDEAU, MISSOURI, AND BEING MORE PARTICULARLY DESCRIBED
AS FOLLOWS
Commence at the Northeast corner of Lot 1, thence South 03"27'08" West, 69 43
feet .more or less to a point, thence South 81040'38" East, 29164 feet more or less
to the Point of Beginning, thence South 29°03'17" East, 28 46 feet more or less to a
point, thence North 59°22'53" East, 10 00 feet more or less to a point, thence
North 29°03'17" West, 20 59 feet more or less to a point, thence North 81°49'49"
West, 12 56 feet more or less to the Point of Beginning Containing 245 26 square
feet more or less
Said right, privilege, pernussion and authority to enter in and upon said
property above described is granted for the purpose of enabling the City, its agents,
servants and assigns, to use said property to excavate, build, maintain, construct,
operate, and repair said waterline from time to time, in, on, upon, or across said
described property, together with all the useful, necessary and proper adjuncts,
appurtenances, and appliances in connection therewith. The City will restore said
property to its former condition as nearly as reasonably possible after completion of the
work being performed This easement and the right, privilege, permission and authority
herein granted is perpetual and shall run with the land
The undersigned covenant that they are the owners in fee simple of the above
described property and have the legal right to convey same
