AN ORDINANCE ACCEPTING VARIOUS EASEMENTS AND
A SPECIAL WARRANTY DEED FROM DRURY LAND
DEVELOPMENT, INC., FOR KELL FARM DRIVE
IMPROVEMENTS FROM RICHMOND DRIVE TO ARNOLD
DRIVE, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts various easements and a special warranty deed from Drury
Land Development Inc., for the Kell Farm Drive improvements from
Richmond Drive to Arnold Drive, conveying to the City of Cape
Girardeau, Missouri, the following described real property, to -
wit.
Tract No. 1 - Sanitary Sewer, Utility and Drainage
A PART OF UNITED STATES PRIVATE SURVEY NO. 3090,
TOWNSHIP 30 NORTH, RANGE 13 EAST OF THE FIFTH
PRINCIPAL MERIDIAN, CITY AND COUNTY OF CAPE GIRARDEAU,
STATE OF MISSOURI, BEING MORE PARTICULARLY DESCRIBED
AS FOLLOWS:
An easement 10' wide for sanitary sewer, utility and
drainage.
Commencing at the southwest corner of Lot No. 4 of
Cape West Seventh Subdivision as recorded in the land
records of the County Recorder's Office in plat book
no. 18 at page 65, from which point the southeast
corner of said lot bears N 680 15' 00" E, 511.33 feet;
said point being on the east line of a tract of land
as recorded in book no. 618 at page no. 122; Thence
along said east line, S 210 45' 00" E, 38.23 feet to a

point on the south line of said tract; Thence along
said south line, S 390 50' 18" W, 244.45 feet to the
True Point of Beginning; Thence leaving said south
line, N 210 44' 53" W, 160.36 feet to the beginning of
a curve concave to the northeast having a central
angle of 070 51' 59" and a radius of 560.00 feet;
Thence along said curve in a northwesterly direction,
76.88 feet; Thence N 130 52' 54" W, 6.73 feet; Thence N
270 11' 03" E, 34.01 feet to a point on the southerly
right of way line of Arnold Drive; Thence along said
right of way S 680 15' 00" W, 15.22 feet; Thence
leaving said right of way, S 270 11' 03" W, 26.28 feet;
Thence S 130 52' 54" E, 10.47 feet to the beginning of
a curve concave to the northeast having a central
angle of 070 51' 59" and a radius of 570.00 feet;
Thence along said curve in a southeasterly direction,
78.26 feet; Thence S 210 44' 53" E, 165.77 feet to a
point on the afore said south line; Thence along said
south line, N 390 50' 18" E, 11.37 feet to the True
Point of Beginning, containing 0.064 acres more or
less.(2,793.82 square feet)
Tract No. 2 - Utility Easement
A PART OF UNITED STATES PRIVATE SURVEY NO. 3090,
TOWNSHIP 30 NORTH, RANGE 13 EAST OF THE FIFTH
PRINCIPAL MERIDIAN, CITY AND COUNTY OF CAPE GIRARDEAU,
STATE OF MISSOURI, BEING MORE PARTICULARLY DESCRIBED
AS FOLLOWS:

point being the beginning of a non -tangent curve
concave to the northwest having a central angle of 03°

radial line bears N 03° 59' 35" W ; Thence along said
curve and right of way in a northeasterly direction,
16.05 feet, Thence leaving said right of way, S 540 04'

to the beginning of a curve concave to the northeast
having a central angle of 070 51' 59" and a radius of
630.00 feet; Thence along said curve in a

ARTICLE 2. This ordinance shall be in full force and
effect ten days after its passage and approval.
