AN ORDINANCE ACCEPTING VARIOUS EASEMENTS AND
A SPECIAL WARRANTY DEED FROM DSW DEVELOPMENT
CORPORATION FOR THE KELL FARM DRIVE
IMPROVEMENTS, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts various easements and a Special Warranty Deed from DSW
Development Corporation for the Kell Farm Drive improvements,
conveying to the City of Cape Girardeau, Missouri, the following
described real property, to -wit:
Utility Easement - DSW Development Corporation
A PART OF UNITED STATES PRIVATE SURVEY NO. 3090,
TOWNSHIP 30 NORTH, RANGE 13 EAST OF THE FIFTH
PRINCIPAL MERIDIAN, CITY AND COUNTY OF CAPE GIRARDEAU,
STATE OF MISSOURI, BEING MORE PARTICULARLY DESCRIBED
AS FOLLOWS:
Commencing at the southwest corner of Lot No. 4 of
Cape West Seventh Subdivision as recorded in the land
records of the County Recorder's Office in plat book
no. 18 at page 65, from which point the southeast
corner of said lot bears N 680 15' 00" E, 511.33 feet;
said point being on the east line of a tract of land
as recorded in book no. 618 at page no. 122; Thence
