AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 1610
NORTH KINGSHIGHWAY, IN THE CITY AND COUNTY
OF CAPE GIRARDEAU, MISSOURI FROM C-1 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of
this ordinance should be rezoned from C-1, Local Commercial
District, to C-2, General Commercial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, May 1, 2006; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from C-1, Local Commercial District, to C-2, General
Commercial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present C-1, Local Commercial District, to
C-2, General Commercial District, for the following described
property:
That part of Lots 2 and 3 of B & E Highway 61 North
Subdivision in the City and County of Cape Girardeau,
State of Missouri, described as follows: Begin at the
Southeast corner of said Lot 2, being on the North
Right of way line of U.S. Route 61; thence North 590
13' 32" West, along said North line, 22.81 feet;
thence continue along said North line, North 550 29'
00" West, 175.00 feet; thence North 340 52' 37" West,
58.73 feet; thence leaving said North right of way
line, North 040 53' 43" East, 262.34 feet; thence
South 670 25' 21" East, 232.20 feet, to the East line
of said Lot 2; thence South 060 47' 09" West, with
said East line, 333.58 feet to the place of beginning
and containing 1.54 acres, more or less.
ALSO: THAT PART OF LOTS 2 AND 3 OF B & E HIGHWAY 61
NORTH SUBDIVISION, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, STATE OF MISSOURI, MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
Commence at the Southeast Corner of said Lot 2 of B &
E Highway 61 North Subdivision, a subdivision on file
in the land records of Cape Girardeau County in Plat
Book 15 at Page 6, also being a point on the north
right of way line of U.S. Route 61; thence with said
north right of way line, North 590 13' 32" West, 22.81
feet; thence continuing on said right of way line,
North 550 29' 00" West, 175.00 feet; thence North 340
52' 37" West, 58.73 feet, to the point of beginning;
thence North 340 52' 37" West, 74.81 feet, thence
North 550 29' 00" West, 2.46 feet; thence leaving said
right of way line, North 040 53' 43" East, 269.49
feet; thence South 750 57' 07" East, 277.81 feet;
thence South 060 47' 09" West, 92.25 feet; thence
North 670 25' 21" West, 232.20 feet; thence South 040
53' 43" West, 262.34 feet to the point of beginning
and containing 0.72 acres more or less and being
subject to any easements of record.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an R-4,
Multiple Dwelling District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties.
Article 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
