AN ORDINANCE ESTABLISHING THE CENTERLINE AND
RIGHT-OF-WAY FOR THE WALNUT STREET EXTENSION
FROM BEAUDEAN LANE TO WEST END BOULEVARD, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The Planning and Zoning Commission of the City
of Cape Girardeau, Missouri, did on April 12, 2006, accept and
approve the Centerline and Right -of -Way Plan for the Walnut
Street Extension from Beaudean Lane to West End Boulevard, as
prepared and submitted by Smith & Co. Engineers and dated April
3, 2006.
ARTICLE 2. The Centerline and Right-of-way Plan for the
Walnut Street Extension as submitted to the Planning and Zoning
Commission and approved by the Planning and Zoning Commission
are hereby adopted and approved by the City Council. The said
centerline is further described, in metes and bounds, as
follows:
ALL THAT PART OF OUT LOT NO. 45 IN USPS 2199, TOWNSHIP
30 NORTH, RANGE 14 EAST OF THE FIFTH PRINCIPAL
MERIDIAN, IN THE COUNTY OF AND CITY OF CAPE GIRARDEAU,
MISSOURI, DESCRIBED AS FOLLOWS:
FROM THE NORTHWEST CORNER OF OUT LOT NO. 45, MEASURE S
6024'44" W, ALONG THE WEST LINE THEREOF, A DISTANCE OF
995.57 FEET, TO A POINT MARKING THE INTERSECTION OF
SAID WEST LINE, WITH THE WESTERLY PROJECTION OF THE
PROPOSED CENTERLINE OF WALNUT STREET; THENCE, S
83037'36" E A DISTANCE OF 9.48 FEET, TO CENTERLINE
STATION 13+23.84, AND THE POINT OF BEGINNING OF SAID
CENTERLINE; THENCE, S 83037'36" E, ALONG SAID
CENTERLINE A DISTANCE OF 96.51 FEET TO CENTERLINE PT
STATION 12+27.33; THENCE, ALONG THE ARC OF A CURVE TO
THE LEFT A DISTANCE OF 200.65 FEET, TO CENTERLINE PC
STATION 10+26.68, SAID CURVE HAVING A RADIUS OF 630.00
FEET, AND A CENTRAL ANGLE OF 18014'55"; THENCE, N
78007'29" E A DISTANCE OF 149.81 FEET TO CENTERLINE PT
STATION 8+76.87; THENCE ALONG THE ARC OF A CURVE TO
THE RIGHT A DISTANCE OF 200.65 FEET TO CENTERLINE PC
STATION 6+76.22, SAID CURVE HAVING A RADIUS OF 630.00
FEET, AND A CENTRAL ANGLE OF 18014'55"; THENCE, S
83037'36" E A DISTANCE OF 676.22 FEET, TO CENTERLINE
STATION 0+00.00, AND THERE TERMINATING.
ARTICLE 3. The City Council of Cape Girardeau, Missouri,
does hereby prohibit any new building or other structure from
being located within the proposed right-of-way of the Walnut
Street Extension, as that right-of-way is determined and
delineated on the plan approved by the Commission on April 12,
2006.
ARTICLE 4. If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
ARTICLE 5. It is the intention of the governing body and
it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances of the
City of Cape Girardeau, Missouri, and the sections of this Code
may be renumbered to accomplish such intention.
ARTICLE 6. This Ordinance shall be in full force and
effect from and after its passage and approval.
