AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF THE
NORTHEAST SIDE OF BRENDA KAY COURT, CITY AND
COUNTY OF CAPE GIRARDEAU, MISSOURI FROM M-1
TO R-4
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of
this ordinance should be rezoned from M-1, Light Industrial
district, to R-4, Multiple Dwelling District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, May 1, 2006; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from M-1, Light Industrial District, to R-4, Multiple
Dwelling District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present M-1, Light Industrial District to R-
4, Multiple Dwelling District, for the following described
property:
THAT PART OF OUTLOT NO. 52 OF UNITED STATES PRIVATE
SURVEY NO. 2199, TOWNSHIP 30 NORTH, RANGE 14 EAST OF
THE FIFTH PRINCIPLE MERIDIAN IN THE CITY AND COUNTY OF
CAPE GIRARDEAU, THE STATE OF MISSOURI, DESCRIBED AS
FOLLOWS:
Commence at the Southeast corner of said Outlot 52;
thence North 81028155" West, 1306.44 feet along the
South line of Outlot 52 to the East right of way line
of West End Boulevard; thence along said East right of
way line, North 07049'38" East, 565.00 feet; thence
leaving said East right of way line, South 81028155",
East, 510.00 feet; thence North 08027'00" East, 281.72

feet, to a point on the south right of way line of
Brenda Kay Court; thence South 81033100" East, with
said right of way line 24.01 feet, to the point of
beginning; thence continue South 81033100" East, 439.17
feet; thence North 07030138" East, 36.35 feet, to the
southwest corner of a tract of described in Deed Book
179 at page 351 of the Land Records of said Cape
Girardeau County; thence continue North 07030138" East,
399.86 feet; thence South 82030'13" East, 329.53 feet;
thence North 07041130" East, 28.35 feet; thence North
81033100" West, 810.22 feet, to the Northeast corner of
a tract described in Deed Book 607 at page 404 of the
Land Records of said Cape Girardeau County; thence
South 08°26'56" West, 199.99 feet; thence South
81033100" East, 49.09 feet; thence South 08°27'00"
West, 270.00 feet, to the point of beginning, and
containing 5.16 acres, more or less. Subject to any
easements of record.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an R-4,
Multiple Dwelling District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties.
Article 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
