AN ORDINANCE ACCEPTING A WATERLINE EASEMENT
FROM GREGG S. HALLMAN AND YVONNE M. HALLMAN,
FOR WATER MAIN IMPROVEMENTS ON COUNTY ROAD
206, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Waterline Easement, executed by Gregg S. Hallman and
Yvonne M. Hallman, husband and wife, conveying to the City of
Cape Girardeau, Missouri, a Waterline Easement for water main
improvements on County Road 206, in the City and County of Cape
Girardeau, Missouri, more particularly described as follows, to -
wit.
THAT PART OF LOT SIX OF ELMWOOD ESTATES SECOND AMENDED
SUBDIVISION, A SUBDIVISION ON FILE IN THE LAND RECORDS
OF CAPE GIRARDEAU COUNTY, MISSOURI IN PLAT BOOK 20 AT
PAGE 54, BEING THAT PART OF UNITED STATES PRIVATE
SURVEY NO. 787, SECTION 10, TOWNSHIP 30 NORTH, RANGE
13 EAST, OF THE FIFTH PRINCIPAL MERIDIAN, IN THE
COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, DESCRIBED
AS FOLLOWS:
Begin at the Northeast corner of Lot 6 of said
subdivision, thence with the East line of said
subdivision, South 05022100" West, 15.31 feet; thence
leaving said East line and with the arc of a non -
tangent curve to the Northwest, being concave to the
Northeast and having a radius of 428.06 feet, and a
length of 204.92 feet, (the chord of said arc bears
North 59019114" West, 202.96 feet), to a point on the
centerline of Flagstone Drive; thence with said
centerline and with the arc of a non -tangent curve to
the Southeast, being concave to the Southwest and
having a radius of 210.14 feet, and a length of 27.00
feet, (the chord of said arc bears South 80053151"
East, 26.98 feet), to a point on the South right-of-
way line of County Road 206 (a.k.a. Benton Hill Road);
thence with said South right-of-way line and with the
arc of a non -tangent curve to the Southeast, being
concave to the Northeast and having a radius of 413.06

feet, and a length of 168.91 feet, (the chord of said
arc bears South 60022141" East, 167.74 feet); thence
South 72005137" East, 3.71 feet, to the point of
beginning and containing 2.847 Square feet or 0.07
acres, more or less.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
