AN ORDINANCE ACCEPTING PERMANENT WATER MAIN EASEMENTS
FROM VARIOUS PROPERTY OWNERS FOR THE CONSTRUCTION AND
MAINTENANCE OF A WATER MAIN IN THE DOWNTOWN AREA
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI,
AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri hereby accepts a Permanent Water Main
Easement executed by the Southeast Missouri University Foundation granting an easement to the City of
Cape Girardeau, Missouri for the construction and maintenance of a new water main in the downtown area,
more particularly described as follows, to -wit:
That part of the 45.50 acre Decatur lot including the Town of Decatur and the City of Cape
Girardeau (Plat Book 1, Page 3) all in U.S.P. Survey no. 2199, Township 30 North, Range 14 East, of
the Fifth Principal Meridian described as follows:
Commence at the northwest corner of Oudot 48 of said Survey no. 2199; thence South 83 degrees
55 minutes 14 seconds East along the North line of Willow Street 21.50 feet to the East line of
Fountain Street; thence North 06 degrees 07 minutes 44 seconds East along the East line of
Fountain Street 887.32 feet to the intersection of the existing East line of Fountain Street and the
north right of way line of new Missouri Route 74 for the point of beginning.
Thence from the point of beginning thence North 06 degrees 07 minutes 44 seconds East along said
East line 20.28 feet; thence North 86 degrees 35 minutes 57 seconds east 58.41 feet to the west right
of way line of new Fountain Street; thence south 03 degrees 24 minutes 03 seconds East along said
east line 20.00 feet to the north right of way line of new Missouri Route 74; thence South 86 degrees
35 minutes 57 seconds West along said North line 58.17 feet to the point of beginning. Containing
1,130 square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri hereby accepts a Permanent Water Main

Girardeau, Missouri for the construction and maintenance of a new water main in the downtown area, more
particularly described as follows, to -wit:

line of new Fountain Street 259.64 feet; thence along a curve being concave to the southeast, having
a radius of 957.00 feet, a chord bearing North 01 degrees 05 minutes 05 seconds East 149.69, for an
arc length of 149.84 feet; thence leaving said East line South 89 degrees 51 minutes 04 seconds East

being concave to the northwest, having a radius of 210.50 feet, a chord bearing North 44 degrees 26
minutes 45 seconds East 260.67 feet, for an arc length of 281.09 feet; thence North 06 degrees 11
minutes 26 seconds east 131.97 feet to a point on the south right of way line of Morgan Oak Street;
thence along said South line along a nontangent curve being concave to the Northwest, having a
radius of 54.05 feet, a chord bearing North 80 degrees 35 minutes 22 seconds East 20.77 feet, for an
Marc length of 20.89 feet; thence leaving said South line South 06 degrees 11 minutes 26 seconds West
137.55 feet; thence along a curve being concave to the Northwest, having a radius of 230.50 feet, a
chord bearing South 44 degrees 26 minutes 42 seconds West 285.44 feet, for an arc length of 307.80
feet; thence South 82 degrees 42 minutes 04 seconds West 34.20 feet; thence North 89 degrees 51
minutes 04 seconds West 90.47 feet; thence South 45 degrees 08 minutes 56 seconds West 38.96
feet; thence along a nontangent curve being concave to the Southeast, having a radius of 937.00 feet,
a chord bearing South 00 degrees 18 minutes 54 seconds East 100.88 feet, for an arc length of 100.93
feet; thence South 03 degrees 24 minutes 03 seconds East 259.64 feet to a point on the north right
of way line of said new Missouri Route 74; thence South 86 degrees 35 minutes 57 seconds West
along said North line 20.00 feet to the point of beginning. Containing 16,085 square feet, more or

ARTICLE 3. The City of Cape Girardeau, Missouri hereby accepts a Permanent Water Main
Easement executed by BSE Property Company, Inc. granting an easement to the City of Cape Girardeau,
Missouri for the construction and maintenance of a new water main in the downtown area, more particularly
described as follows, to -wit:
PART OF DECATUR LOT (1sT GIBONEY-HOUCK SUBDIVISION) IN U.S.P. SURVEY 2199,
TOWNSHIP 30 NORTH, RANGE 14 EAST OF THE FIFTH PRINCIPAL MERIDIAN AS
SHOWN IN PLAT BOOK 1, PAGE 12 IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
Commence at the intersection of the extended south right of way line of Jefferson Street with the
East right of way line of Asher Street; thence South 08° 00 ` 00" West along the East line ofAsher
Street 380.00 feet to the point of beginning. Thence from the point of beginning, South 82° 00'00"
East 176.00 feet to a point on the West right of way line of Old Fountain Street; thence South 08°
00'00" West along said West line 20.00 feet to the northeast corner of a tract of land described in
Document No. 2005-03044, in the Cape Girardeau County Recorder's Office; thence North 82° 00'
00" West along said North line 176.00 feet to the northwest corner of said tract on the East line of
Asher Street; thence North 08° 00'00" East along said East line, 20.00 feet to the point of
beginning. Containing 3,520 square feet, more or less.
ARTICLE 4. This ordinance shall be in full force and effect ten days after its passage and approval.
