AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PROPERTY
LOCATED AT 1520 NORTH MOUNT AUBURN ROAD, IN
THE CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI, FROM R-1 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from R-1, Single-Family Suburban Residential
District, to C-2, Highway Commercial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and a public hearing was held on
Monday, June 6, 2022; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 of this ordinance from R-1, Single-Family Suburban
Residential District, to C-2, Highway Commercial District.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present R-1, Single-Family Suburban
Residential District, to C-2, Highway Commercial District, for
the following described property:
A part of the East Half of the Northwest Quarter and a part
of the Southwest Quarter of the Northeast Quarter of
Fractional Section 26, Township 31 North, Range 13 East,
City and County of Cape Girardeau, State of Missouri,
described as follows :
Beginning at the Northeast corner of a tract of land
described in Book 112, page 195 of the County Land Records,
said point being on the Southerly right-of-way line of U.
S . Route 61; thence N. 54 deg. 01' 12" W. 80 .25 feet along
said right-of-way line to the east right-of-way line of
Mount Auburn Road; thence along said East line the
following courses and distances : thence S . 21 deg. 44' 47"
W. 11 .21 feet; thence S . 24 deg. 46' 24" W. 53 . 65 feet;
thence S. 10 deg. 33' 18" W. 41 .79 feet; thence S. 06 deg.
23' 01" W. 31 .29 feet; thence S . 12 deg. 33' 04" W. 36 .85
feet; thence leaving said right-of-way, N. 42 deg. 40' 00"
E. 163 .36 feet to the point of beginning, containing 0 . 17
acres .
ARTICLE 2 . The City Council hereby finds and declares that
the property described in Article 1 of this ordinance is at the
present time particularly suitable for the purposes and uses of
the C-2, Highway Commercial District, and that such changes
authorized hereby are reasonable and in reasonable conformity
with the existing uses and value of the immediately surrounding
properties .
ARTICLE 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .
