AN ORDINANCE AMENDING THE BOUNDARIES OF WARD
4 TO INCLUDE PROPERTIES OF JONES AND KENNON
DEVELOPMENT, L.L.C., AND AARON'S PROPERTIES,
L.L.C., AND WARD 6 TO INCLUDE PROPERTIES OF
PRESTWICK HOLDINGS, L.L.C.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Ordinance No. 1355, Part 2, is hereby amended
by repealing the legal description of the boundaries of "Ward 4"
in its entirety and enacting a new legal description of the
boundaries of "Ward 4", in words and figures, to read as
follows:
WARD 4
Beginning at a point where the centerline of Perry
Avenue intersects the centerline of Perryville Road;
thence in a northerly direction with said centerline
of Perry Avenue to its intersection with the
centerline of Wayne Street; thence in an easterly
direction with the centerline of Wayne Street to its
intersection with the centerline of West End
Boulevard; thence in a northerly direction with the
centerline of West End Boulevard to its intersection
with the centerline of Bertling Street; thence in an
easterly direction with the centerline of Bertling
Street to its intersection with the centerline of Old
Sprigg Street Road; thence in a northerly direction
with the centerline of Old Sprigg Street Road to its
intersection with the Northern City limits of the
City of Cape Girardeau effective September 4, 2001;
thence north along the west right-of-way line of Old
Sprigg Street Road to the north line of the Southwest
Quarter of the Southeast Quarter of Section 19,
Township 31 North, Range 14 East; thence west to the
east right-of-way line of Cape Rock Drive; thence in a
northerly direction along the east right-of-way line
of Cape Rock Drive to the northern City limits of the
City of Cape Girardeau effective September 4, 2001 to
the western right-of-way line of Cape La Croix Road
(State Route W); thence north along said right-of-way
line to the south line of an existing 50 foot wide

ingress and egress easement (Deer Creek Road); thence
following said line west to the east line of Lot No. 4
of Cape La Croix Farms Subdivision as recorded in plat
book no. 17 at page no. 12; thence S 130 56' 31" E,
487.41 feet; thence following the northern city limits
of the City of Cape Girardeau effective September 4,
2001 to the north line of lot 7 of the Route W
Commercial Center; thence including lots 5, 6 and 7 of
the Route W Commercial Center; thence to the northwest
corner of lot 4 of the Route W Commercial Center;
thence following the City limits line effective
September 4, 2001 to the north line of Lot number 18
of the Lynwood Hills Second Amended Subdivision;
thence west along the north line of Lot number 18 to
the City limits line effective September 4, 2001;
thence following the City limits line effective
September 4, 2001 to the west right-of-way line of
Interstate 55; thence in a southerly direction along
the west right-of-way line of Interstate 55 to its
intersection with the centerline of Kingshighway;
thence in a southeasterly direction with the
centerline of Kingshighway to its intersection with
the centerline of Lexington Avenue; thence in a
northeasterly direction with the centerline of
Lexington Avenue to its intersection with the
centerline of Rampart Street; thence in a southerly
direction with the centerline of Rampart Street to its
intersection with the centerline of Jasmine Lane;
thence in an easterly direction with the centerline
of Jasmine Lane to its intersection with the
centerline of Carolina Street; thence in a southerly
direction with the centerline of Carolina Street to
its intersection with the centerline of Lisa Drive;
thence in an easterly direction with the centerline of
Lisa Drive to the end of its construction as of
September 4, 2001; thence eastwardly along the
extension of the centerline of Lisa Drive, more or
less parallel to the centerline of Melrose Avenue, to
the centerline of a platted, but unconstructed,
section of Lisa Drive west of Westwood Drive; thence
easterly along said centerline to its intersection
with the centerline of Westwood Drive; thence in a
northeasterly direction with the centerline of
Westwood Drive to its intersection with the
centerline of Perryville Road; thence in a
southeasterly direction with the centerline of
Perryville Road to its intersection with the
centerline of Perry Avenue, being the point of
beginning of the Ward herein described.
ARTICLE 2. Ordinance No. 1355, Part 2, is hereby amended
by repealing the legal description of the boundaries of "Ward 6"
in its entirety and enacting a new legal description of the
boundaries of "Ward 6", in words and figures, to read as
follows:
WARD 6
Beginning at a point where the centerline of Henderson
Avenue intersects with the centerline of Jefferson
Avenue; thence in a southerly direction with said
centerline of Henderson Avenue to its intersection
with the centerline of College Street; thence in a
westerly direction with the centerline of College
Street to its intersection with the centerline of West
End Boulevard; thence in a southerly direction with
the centerline of West End Boulevard to its
intersection with the centerline of Southern
Expressway; thence in a southwesterly direction with
the centerline of Southern Expressway to its
intersection with the centerline of Kingshighway;
thence in a southerly direction with the centerline of
Kingshighway to its intersection with the centerline
of Old U.S. Highway No. 61; thence in a southerly
direction with the centerline of Old U.S. Highway No.
61 to its intersection with the Southern City limits
of the City of Cape Girardeau effective September 4,
2001; thence following the City limits line effective
September 4, 2001, in a general northward and westward
direction to the east line of U.S.P.S. 194; thence
including the land area known as the Prestwick
Plantation, annexed effective April 12, 2002 and the
Prestwick Plantation/Dalhousie Clubhouse property,
annexed effective August 30, 2002, to the southwest
corner of the Giboney Woods Subdivision; thence
following the City limits line effective September 4,
2001, in a general westward, eastward and northward
direction to its intersection with the centerline of
Kingshighway just west of the Kingshighway interchange
with Interstate 55; thence in a southeasterly
direction with the centerline of Kingshighway to its
intersection with the centerline of Mt. Auburn Road;
thence in a southerly direction with the centerline of

Mt. Auburn Road to its intersection with the
centerline of Themis Street; thence in an easterly
direction with the centerline of Themis Street to its
intersection with Pindwood Lane; thence in a southerly
direction with the centerline of Pindwood Lane to its
intersection with the centerline of Independence
Street; thence in an easterly direction with the
centerline of Independence Street to its intersection
with the centerline of Gordonville Road; thence in a
southwesterly direction with the centerline of
Gordonville Road to its intersection with the
centerline of Edgewood Drive; thence in a southerly
direction with the centerline of Edgewood Drive to its
intersection with Jan Drive; thence in an easterly
direction with the centerline of Jan Drive to its
intersection with the centerline of Nancy Drive;
thence in a southeasterly direction with the
centerline of Nancy Drive to its intersection with the
centerline of Bloomfield Road; thence in a
northeasterly direction with the centerline of
Bloomfield Road to its intersection with the
centerline of Albert Street; thence in a southerly
direction with the centerline of Albert Street to its
intersection with the centerline of Brink Street;
thence in an easterly direction with the centerline of
Brink Street to its intersection with the centerline
of Minnesota Avenue; thence in a northerly direction
with the centerline of Minnesota Avenue to its
intersection with the platted centerline of Herman
Street; thence in a northeasterly direction to the
intersection of the centerline of Missouri Avenue and
Jefferson Avenue; thence in an easterly direction with
the centerline of Jefferson Avenue to its intersection
with the centerline of Henderson Avenue, being the
point of beginning of the Ward herein described.
ARTICLE 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
ARTICLE 4. It is the intention of the governing body and
it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances of the
City of Cape Girardeau, Missouri, and the sections of this Code
may be renumbered to accomplish such intention.
ARTICLE 5. This ordinance shall be in full force and
effect ten days after its passage and approval.
