AN ORDINANCE ACCEPTING A GENERAL WARRANTY DEED
FROM DSW DEVELOPMENT CORPORATION FOR THE
EXTENSION OF INDEPENDENCE STREET BETWEEN MT.
AUBURN ROAD AND FARRAR DRIVE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri hereby accepts a General Warranty Deed
executed by DSW Development Corporation conveying to the City of Cape Girardeau, Missouri
property for the extension of Independence Street between Mt. Auburn Road and Farrar Drive, more
particularly described as follows, to -wit:
A PART OF UNITED STATES PRIVATE SURVEY NO. 3090, TOWNSHIP 30
NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN, CITY AND
COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
Beginning at a '/z " iron pin being the northwest corner of Lot no. 1 of DSWD Independence
Subdivision No. 1, from which the southwest corner of said lot bears, S 03° 56' 41" W, 287.67
feet; Thence along the north line of said lot, S 86° 03' 19" E, 190.55 feet to a point on the
westerly right of way of Mount Auburn Road; Thence leaving the afore said north line and
along said right of way, N 03° 56' 41" E, 80.00 feet; Thence leaving said right of way, N 86°
03' 19" W, 635.15 feet to the beginning of a curve concave to the northeast having a central
angle of 90° 42' 34" and a radius of 20.00 feet; Thence along said curve in a northwesterly and
northeasterly direction, 31.66 feet to a point on the easterly right of way of Farrar Drive;
Thence along said right of way, S 04° 39' 15" W, 120.01 feet to the point of cusp with a curve
concave to the southeast having a central angle of 89° 17' 26" and a radius of 20.00 feet from
which point a radial line bears S 85° 20' 45" E; Thence leaving said right of way and along said
curve in a northeasterly and southeasterly direction, 31.17 feet; Thence S 86° 03' 19" E, 446.09
feet to the TRUE POINT of BEGINNING, containing 1.208 acres more or less (52,643.38
square feet), sub)ect to all matters of record but free and clear of all liens and encumbrances
(the "Title Exceptions").
ARTICLE 2. This ordinance shall be in full force and effect ten days after its passage and
approval. n
