AN ORDINANCE ACCEPTING A PERMANENT SEWER
EASEMENT FROM RHODES 101 CONVENIENCE STORES,
INC., AND SOUTHEAST MISSOURI SIGMA CHI
FRATERNITY ASSOCIATION FOR CONSTRUCTION AND
MAINTENANCE OF A SANITARY SEWER
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri hereby
accepts a Permanent Sewer Easement executed by Rhodes 101
Convenience Stores, Inc., conveying to the City of Cape Girardeau,
Missouri an easement for the construction and maintenance of a
sanitary sewer, more particularly described as follows:
A PART OF LOT FIVE AND A PART OF A VACATED ALLEY IN BLOCK
4 OF THE MARBLE CITY HEIGHTS ADDITION TO THE CITY OF CAPE
GIRARDEAU, COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
DESCRIBED AS FOLLOWS:
Beginning at a point on the south line of said Lot 5,
said point being S 82000100" E, 2.50 feet from the
southwest corner of said lot 5; Thence along said south
line, N 82000'00" W, 10.00 feet to the centerline of a
vacated alley; Thence N 07°45'47" E, 12.22 feet along
said centerline; Thence leaving said centerline N
39059115" E, 18.75 feet; Thence S 07°45'57" W, 28.13 feet
to the point of beginning; containing 202 square feet.
Article 2. The City of Cape Girardeau, Missouri hereby
accepts a Permanent Sewer Easement executed by Southeast Missouri
Sigma Chi Fraternity Association, conveying to the City of Cape
Girardeau, Missouri an easement for the construction and
maintenance of a sanitary sewer, more particularly described as
follows:
A PART OF LOT 5 OF BLOCK 4 OF THE MARBLE CITY HEIGHTS
ADDITION TO THE CITY OF CAPE GIRARDEAU, COUNTY OF CAPE
GIRARDEAU, MISSOURI, STATE OF MISSOURI, DESCRIBED AS
FOLLOWS:
Beginning at a point on the south line of said Lot 5,
said point being S 82000'00" E, 2.50 feet from the
southwest corner of said lot 5; Thence N 07045157" E,

28.13 feet along a line parallel with the west line of
said lot 5; Thence N 39059'15" E, 25.76 feet to a point
on the north line of said lot 5; Thence along said north
line, S 82°00'00" E, 17.69 feet; Thence S 39059115" W,
59.93 feet to the point of beginning; containing 635
square feet.
Article 3. This ordinance shall be in full force and
effect 10 days after its passage and approval.
