AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 2633
HOPPER ROAD, CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI FROM R-1 TO C-1
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-1, Single Family Residential
District, to C-1, Local Commercial District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday, October
7, 2002; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-1, Single Family Residential District, to C-1, Local
Commercial District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-1, Single Family Residential District, to C-1,
Local Commercial District, for the following described property:
TRACT I:
The West 60 feet of Lot 4, Pleasant Acres, a Subdivision
of Lot 1, Block 4 and a part of Lot 9, Block 4, of Rodney
Vista, a subdivision of Out Lot 79, U. S. P. Survey 2199,
in the City of Cape Girardeau, Missouri.
TRACT II:
All of the Northwest Quarter of the Northeast Quarter of
Section Thirty-five (35), Township thirty-three (33),
Range Thirteen (13) East, containing in the aggregate
forty (40) acres.
ALSO: Two (2.00) acres, more or less, and being a
triangular tract of land lying in the south part of the
South 1/2 of the Southeast Quarter of Section No. twenty-
six (26) in Township thirty-three (33) North of Range
Thirteen (13) East and all lying south of the creek and
separated from the land heretofore conveyed lying on the
north side of said creek -conveyed by Book 112 page 318 of
the land records of Cape Girardeau County, Missouri.
The North line of the tract conveyed being the creek, and
running to a point; the south line being the south line
of said Section 26 and the west side being the County
road running north and south to the Pocahontas and Neelys
Landing Road.
Also:
All that part of the Southwest quarter of the southeast
quarter of Section 26, Township 33 North, Range 13 East,
in the County of Cape Girardeau, Missouri, described as
follows:
Begin at the southeast corner of the southwest quarter of
the southeast quarter of section 26, T. 33 N. R. 13 E.,
being marked by an old iron pin and run west along the
section line between sections 26 and 35 a distance of
1343.9 feet to the quarter corner marked by an old iron
pin; thence north 423.1 feet to a point in the creek;
thence north 450 east with said creek 40 feet; thence
south 670 east, 100 feet; thence north 630 east 260 feet;
thence south 550 East, 115 feet; thence north 50 east 65
feet; thence south 580 east 200 feet; thence south 82°
east 140 feet; thence south 430 east 120 feet; thence
south 710 east, 330 feet; thence south 830 east 146 feet
the intersection of said creek with the east line of the
southwest quarter of the southeast quarter of Section 26;
thence south with said quarter line 169.7 feet to the
point of beginning, containing 11.038 acres more or less.
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of C-1, Local
Commercial District, respectively, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
