AN ORDINANCE DECLARING IT NECESSARY TO MAKE
SEWER IMPROVEMENTS IN LATERAL SEWER DISTRICT
NO. 14-K-7, A SUBDIVISION OF TRUNK SEWER
DISTRICT NO. 14-K, TO SERVE CERTAIN PROPERTIES
ALONG PERRYVILLE ROAD, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Council of the City of Cape Girardeau,
Missouri, hereby declares that a public necessity exists for
sanitary purposes for making certain sewer improvements in Lateral
Sewer District No. 14-K-7, including the construction of a sanitary
sewer eight (8) inches in diameter along with manholes, wyes,
pavement restoration and other necessary appurtenances to serve
certain properties in Lateral Sewer District No. 14-K-7, all as
shown on the plans and specifications for said improvements. It is
the intention of the City Council to have this project done by
contract and to tax bill those particular property owners in
Lateral Sewer District No. 14-K-7 for the cost of the project.
ARTICLE 2. A public hearing will be held before the City
Council at 7:00 P.M. on Monday, October 7, 2002, at City Hall, 401
Independence, Cape Girardeau, Missouri at which citizens and all
interested parties may express their assent or objection to the
project.
ARTICLE 3. The City Clerk is hereby directed to publish
notice for seven (7) consecutive insertions in a daily paper that
the items set forth in Article 1 have been filed with the City
Clerk for public inspection and that a public hearing will be held
at the time and place and for the purpose stated in Article 2.
ARTICLE 4. Pursuant to Section 3.15 of the Charter of the
City of Cape Girardeau, Missouri, this measure is adopted as an
emergency measure as it constitutes a Bill concerning the immediate
preservation of public peace, property, health, safety or morals,
due to the fact that this work will replace septic tanks that do
not work and discharge sewage onto the neighbors, property.
Accordingly, this ordinance will take effect immediately upon its
passage and approval.
