AN ORDINANCE ACCEPTING PERMANENT SEWER EASEMENTS
AND TEMPORARY CONSTRUC'T'ION EASEMENTS FROM VARIOUS
PROPERTY OWNERS FOR THE ARENA CREEK SANITARY SEWER
PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri hereby accepts a Temporary
Construction Easement executed by Eddie Erlbacher Properties, Inc., conveying to the City of Cape
Girardeau, Missouri an easement for the Arena Creek Sanitary Sewer Project, more particularly
described as follows, to -wit:
A TRACT OF LAND BEING IN THE EAST PART OF ALLEN'S SUBDIVISION OF
OU MOTS 76 AND 77,U.S.P. SURVEY NO. 2199, CITY OF CAPE GIRARDEAU,
MISSOURI, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
Commencing at the Southwest corner of land now or formerly of Eddie Erlbacher
Properties, Inc., as recorded in deed book 265 page 495, Cape Girardeau County records;
thence along the West line of said Erlbacher land, North 36° 48'00" West, 17.44 feet to the
True Point of Beginning; thence continuing along said West line North 36° 48'00" West,
15.12 feet; thence leaving said West line, North 60° 25'34" East, 44.83 feet to the East line

MISSOURI, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
Beginning at the intersection of the west line of Kingsway (30'w) drive with the south line of
land now or formerly of Eddie Erlbacher Properties, Inc. as recorded in Book 265 Page 495,
Cape Girardeau Records; thence along said south line north 83° 38'00" west, 44.00 feet to
the east line of U.S. Route 61; thence along said east line, north 36° 48'00" west, 17.44 feet;
thence leaving said east line and continuing the following courses and distances: north 60°
