ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 1217,
1223, 1235, 1237, 1243, 1257 and 1220 ROCKWOOD
DRIVE, CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI FROM R-3 TO R-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-3, Two -Family Residential
District, to R-2, Single Family Residential District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Tuesday,
September 3, 2002; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-3, Two -Family Residential District, to R-2, Single Family
Residential District.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-3, Two -Family Residential District to R-2,
Single Family Residential District for the following described
property:
TRACT I - Parsons
All of Lot Numbered Twenty-one (21), except a strip of land 5 feet
in width off the West side of said Lot,
All of Lot Numbered One (1),
The North 10 feet of Lot Numbered Two (2),
The West 10 feet of Lot Numbered Three (3) and
The West 10 feet of the South 54 feet of Lot Numbered Two (2),
All in Block "A" of Rockwood Place, a subdivision in the City of
Cape Girardeau, Missouri, as shown by Plat recorded in Plat Book 3
at page 37, land records of Cape Girardeau County, Missouri.
TRACT II - Holliday
Lot Twenty ( 2 0 ) and the West five ( 5 ) feet of Lot Twenty-one ( 21)
in Block "A" of Rockwood Place Subdivision in the City and County
of Cape Girardeau, Missouri, as shown by plat recorded in Plat Book
3 at page 37, and more particularly described as follows: Beginning
at the northwest corner of said Lot 20; thence South 07 degrees
00'00" West along the west line thereof, 168.55 feet; thence South
83 degrees 44'21" East, 65.00 feet to an iron pipe; thence North 07
degrees 00'00" East, 196.29 feet to a chisled cross on the south
right of way line of Rockwood Drive; thence southwesterly along a
curve to the right with a radius of 568.42 feet a length of 71.05
feet (chord bears South 73 degrees 15' 57" West, 71.00 feet) to the
place of beginning.

TRACT IV - Parry

All of the West Half of Lot Eighteen (18) and The East 30 feet of
Lot Seventeen (17) in Block "A" Rockwood Place, a Subdivision in
the City of Cape Girardeau, Missouri. Subject to easements of
record.
TRACT V - Landewe
The West 35 feet of Lot Seventeen (17) and the East 25 feet of Lots
Fourteen (14), Fifteen (15) and Sixteen (16), being a parcel 60
feet in width, all in Block "A" of Rockwood Place Subdivision in
the City of Cape Girardeau, Missouri, more particularly described
as follows: Begin at a point on the south line of Lot 17 that is
35 feet east of the southwest corner of said Lot 17; thence run
West 60 feet along the south line of Lots 17 and 14 to a point 25
feet west from the southwest corner of said Lot 17; thence North
parallel with the west line of Lot 17 to intersect with the north
line of said Lot 16, which is the south line of Rockwood Drive;
thence in an Easterly direction on the south line of said drive to
a point 35 feet perpendicularly distance from the west line of said
Lot 17; thence South parallel with the west line of said Lot 17 to
the point of beginning.

TRACT VI - Weakley
All of the West Sixty-five (65) feet of Lots Fourteen (14), Fifteen
(15) and Sixteen (16) of Block "A" of Rockwood Place Subdivision of
the City of Cape Girardeau, more particularly described as follows:
Begin at a point on the south line of said Lot 14, that is 65 feet
east of the southwest corner of said Lot 14 and run west on the
south line of said Lot 14 a distance of 65 feet to said southwest
corner; thence north on the west lines of said lots 14, 15 and 16,
being also on the east line of West End Boulevard 208 feet to the
intersection of the east line of said Boulevard with the south line
of Rockwood Drive; thence in an easterly direction along the south
line of Rockwood Drive to a point 65 feet perpendicularly distant
from the east line of said Boulevard; thence parallel with the east
line of said Boulevard run south to the point of beginning.
A parcel Sixty (60) feet in width out of Lots Fourteen (14),
Fifteen (15) and Sixteen (16) of Block "A" of Rockwood Place
Subdivision in the City of Cape Girardeau, more particularly
described as follows: Begin at a point on the south line of said
Lot 14, that is 65 feet east of the southwest corner of said Lot
14; thence run east 60 feet along the south line of said Lot 14 to
a point 25 feet west of the southeast corner of said Lot 14; thence
North parallel with the east lines of said Lots 14, 15 and 16 to
intersect with the north line of said Lot 16 which is the south
line of Rockwood Drive; thence in a westerly direction on the south
line of Rockwood Drive to a point 65 feet perpendicularly distant
from the west line of said Lots 14, 15 and 16 which west line is
the east line of West End Boulevard; thence south parallel with the
east line of West End Boulevard to the point of beginning.
TRACT VII - Seabaugh
Lot Four (4) in Block "D" of Rockwood Place in the City and County
of Cape Girardeau, Missouri, as shown by plat recorded in Plat Book
3 at page 37.
Except a strip of land of the uniform width of three (3) feet off
the entire East side of said lot, the East line of said lot shall
be the East line of said strip, and the West line of said strip
shall be a line running parallel to and at a distance of three (3)
feet (measured at right angles) West of the East line of said Lot
Four (4) in Block "D" of Rockwood Place as aforesaid.
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of R-2, Single
Family Residential District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding properties.

ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
