AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING of 600, 601,
610, 633, 635, 636, 637, 643, 646, 656, 678,
689 and 690 HIGHLAND DRIVE, CITY AND COUNTY OF
CAPE GIRARDEAU, MISSOURI FROM R-3 TO R-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-3, Two -Family Residential
District, to R-2, Single Family Residential District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Tuesday,
September 3, 2002; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-3, Two -Family Residential District, to R-2, Single Family
Residential District.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-3, Two -Family Residential District, to R-2,
Single Family Residential District, for the following described
property:
TRACT I - Froemsdorf
All of Lot One (1) in Block "B" of Rockwood Place in the City of
Cape Girardeau, Missouri.
TRACT II - Blattner
Lots Two (2), Three (3), Four (4) and the South 10 feet of Lot Five
(5) in Block "B" of Rockwood Place Subdivision, a Replat of Block
B in the City and County of Cape Girardeau, Missouri, as shown by
plat recorded in Plat 4 at page 28.
TRACT III - Stahly
Lot Six (6) of Block "B" of Rockwood Place in the City of Cape
Girardeau, Missouri, as shown by plat recorded in Plat Book 4 at
page 28.
ALSO: The South 27 feet of Lot Ten (10) and all of Lot Eleven (11)
of West Highland Place in the City of Cape Girardeau, Missouri, as
shown by plat recorded in Plat Book 4 at page 28.
ALSO: And a parcel of land being a part of Block "C" of Rockwood
Park of West Highland Place Subdivision in the City and County of
Cape Girardeau, Missouri, as shown in plat recorded in Plat Book 4
at page 28.
Begin at the Southeast corner of Lot 11 of said West Highland Place
Subdivision; thence South 7 degrees 00' West, 21.0 feet; thence
South 55 degrees 00' 13" West, 219.32 feet to the Southeast Corner
of Lot 6, Block "B" of Rockwood Place Subdivision; thence North 38
degrees 15' East, along the Easterly line of said Lot 6, 197.1 feet
to a point in the South line of said Lot 11, thence South 82
degrees 17' East along the South line of said Lot 11, 60.75 feet to
the point of beginning.
TRACT IV - Maher
All of the South 46.3 feet of Lot Numbered One (1) of West Highland
Place in the City of Cape Girardeau, Missouri, as shown by Plat
recorded in Plat Book 4 at page 28, land records of Cape Girardeau
County, Missouri.
And all of the North 55.95 feet of Lot Numbered Five (5) in Block
"B" of resubdivision of Rockwood Place, as shown by Plat recorded
in Plat Book 4 at page 28, land records of Cape Girardeau County,
Missouri.
TRACT V - Stevenson
The North 17. 52 feet of Lot One (1) , all of Lot Two ( 2 ) and the
South 7.50 feet of Lot Three (3) in West Highland Place in Out Lot
No. 37, in the City of Cape Girardeau, Missouri, being a
resubdivision of the west part of Highland Place, now known and
designated as West Highland Place, as fully shown on the plat of
said subdivision filed in the office of the Recorder of Deeds at
Jackson, Missouri. Said property has a frontage of 90.10 feet on
Highland Drive and a frontage of 90.90 feet on West End Boulevard.
TRACT VI - Sessoms
All of Lot Nine (9) and the North 33 feet of Lot Ten (10) of West
Highland Place in Out Lot 37, U.S.P. Survey 2199, in the City of
Cape Girardeau, Missouri, more particularly described as follows:

Begin at the Northwest corner of said Lot 9 and run Easterly 146.9
feet to the northeast corner of said Lot 9; thence run Southerly on
the east line of said Lot 9 and then on the east line of said Lot
10, a distance of 96 feet to a point; thence Westerly parallel with
the north line of said Lot 10, 141.2 feet to the east line of
Highland Drive; thence Northerly on the east line of Highland
Drive, 96.12 feet to the point of beginning.
TRACT VII - Tracy
The North 57.55 feet of Lot Three (3) and the South 39.95 feet of
Lot Four (4) in West Highland Place in Out Lot 37 in the City of
Cape Girardeau, Missouri, as shown by Plat recorded in Plat Book 4
at page 28, land records of Cape Girardeau County, Missouri.
TRACT VIII - Shuck
All of Lot Five (5) and the North part of Lot Four (4) West
Highland Place in Out Lot 37, U.S.P. Survey 2199 in the City of
Cape Girardeau, Missouri, described as follows:
Begin on the west line of Highland Drive at the northeast corner of
the property sold to Burton Gerhardt and Katherine Harris Gerhardt,
his wife, by deed dated and acknowledged on February 28, 1946;
thence in a Northerly direction on the west line of Highland Drive
90.05 feet to the northeast corner of said Lot 5; thence Westerly
on the north line of said Lot 5, 160 feet to the northwest corner
of said Lot 5 on the east line of West End Boulevard; thence
Southerly on said east line to the northwest corner of the said
property sold said Gerhardt; thence easterly on the north line of
said property sold Gerhardt to the point of beginning on Highland
Drive; the property herein intended to be described being all of
said Lots 4 and 5 not heretofore sold to the said Gerhardts by said
Deed of February 28, 1946.
TRACT IX - Stamp
All of Lot Eight (8) of West Highland Place, a Subdivision in the
City of Cape Girardeau, Missouri, as shown by Plat recorded in Plat
Book 4 at Page 28.
TRACT X - Yallaly
Part of Lots Six (6) and Seven (7) of West Highland Place in the
City of Cape Girardeau, Missouri, as shown by Plat recorded in Plat
Book 4 at page 28, described as follows: Begin at a concrete
monument at the Northeast corner of said Lot 6; thence in a
Southwesterly direction, 64.56 feet to a point in the line between
Lots 6 and 7, said point being 14.1 feet West of the East corner of
Lots 6 and 7; thence Southwesterly 63.11 feet to a point in the

line between Lots 7 and 8 of West Highland Place, said point being
17.8 feet West of the East corner of Lots 7 and 8; thence West
along the line between Lots 7 and 8, 124.4 feet to the Southwest
corner of Lot 7 in the East line of Highland Drive; thence North
along the East line of Highland Drive and the West line of Lots 7
and 6, 126.0 feet to the Northwest corner of Lot 6; thence East
along the North line of Lot 6, 140.7 feet to the point of
beginning.
TRACT XI - Ferguson
Part of Out Lot 37, U.S.P. Survey 2199, City of Cape Girardeau,
Missouri, described as follows: Start at the intersection of the
West line of Out Lot 37 and the North line of Highland Drive as
recorded in Plat Book 4 at page 28 of the land records of Cape
Girardeau County, Missouri; thence South 7 degrees 0' West, along
the West line of Out Lot 37, 156.35 feet; thence South 82 degrees
27' East, 200.0 feet to an intersection with the East line of
Highland Drive for the point of beginning; thence Northwesterly
along the East line of Highland Drive, along a 36 degrees 44' curve
to the left having a radius of 156.0 feet, a distance of 142.5
feet; thence North 71 degrees 15' East, 186.0 feet; thence South 77
degrees 30' East, 149.0 feet to a point in the West line of
Johnson's First Addition; thence with said West line, South 27
degrees 33' West, 45.0 feet; thence South 6 degrees 55' West, 140.6
feet to a point on the North line of Lot 2 of the Highland Place
Addition; thence North 82 degrees 27' West, along the North line of
Highland Place Addition, 247.7 feet to the point of beginning.
TRACT XII - Tracey
Part of Out Lot 37, of U.S.P. Survey No. 2199, Township 31 North,
Range 14 East, more particularly described as follows:
Beginning at an iron rivet set in a concrete monument on the West
line of Out Lot 37, said concrete monument being 374.0 feet North
from a cross cut in the concrete pavement of the corners of Out
Lots 29, 37, 38 and 39; thence with an angle of 900 33' in an
Easterly direction, 160 feet to a point on the West line of
Highland Drive; thence running in a Northerly direction along the
West line of Highland Drive and with a curve bearing Westerly with
an angle of 890 33' for a distance of 181.3 feet, said curve having
a radius of 116 feet; thence continuing in a Westerly direction now
on the South line of Highland Drive a distance of 46.03 feet to a
point; thence running in a Southerly direction along the West line
of Out Lot 37, 116.35 feet to the point of the beginning.
Part of Block No. Two (2) of College Park Addition, being a
subdivision of Part of Out Lot 38 of U.S.P. Survey No. 2199,
Township 31 North, Range 14 East, more particularly described as
follows:

Beginning at an iron pin set in a concrete monument on the East
side of West End Boulevard said concrete monument being 370.35 feet
North from a cross cut in the concrete pavement at the corners of
Out Lots 29, 37, 38 and 39; thence in a Northwesterly direction
along the Easterly line of West End Boulevard, 144.85 for a corner;
thence running in an Easterly direction, parallel to the South line
of Highland Drive, 75 feet to a corner; thence in a Southerly
direction along the East line of Out Lot 38, 123 feet to the point
of beginning.
Part of Lot Eight (8) in Block One (1) of Monticello Addition to
the City of Cape Girardeau, Missouri, more particularly described
as follows:
Beginning at a point on the South line of Highland Drive, which
point is North 125 feet from an iron pin set in a concrete monument
on the East side of West End Boulevard said concrete monument being
370.35 feet North from a cross cut in the concrete pavement at the
corners of Out Lots 29, 37, 38 and 39; thence with an angle of 91°
and running in a Westerly direction along the south line of
Highland Drive, 75.4 feet to a point on the East line of West End
Boulevard; thence running in a Southerly direction with an angle of
580 18' for a distance of 2.05 feet to a point also on the East
line of West End Boulevard; thence East, parallel with the South
line of Highland Drive, 75 feet to a corner; thence in a Northerly
direction a distance of 2.00 feet to the point of beginning.
TRACT XIII - Welch
All of Lot Seven (7) in Block One (1) of Monticello Addition to the
City of Cape Girardeau, Missouri.
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of R-2, Single
Family Residential District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
