AN ORDINANCE AMENDING SECTION 30-39(d)(41) OF
THE CITY CODE RELATING TO SPECIAL USE
REGULATIONS FOR THE PLACEMENT OF TEMPORARY
MANUFACTURED BUSINESS UNITS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 30-39(d) (41) of the Code of Ordinances
of the City of Cape Girardeau, Missouri, reading as follows:
Sec. 30-39. Special use regulations.
(d) Special uses.
(41) Placement of manufactured business units, or
modular units approved by the State of Missouri,
for temporary office, classroom or storage
purposes only during construction or remodeling
of a main hospital, school building, and located
on the same site, in any district. Any special
use permit, if approved, will become effective
only upon the issuance of a building permit for a
main building. All such temporary business units
shall be removed upon occupancy of the completed
construction or completion or abandonment of the
construction work, whichever occurs first.

39(d)(41) is hereby enacted in lieu thereof, in words and
figures, to read as follows:

and located on the same site, in any district.
Any special use permit, if approved, will become

business units shall be removed upon occupancy of
the completed construction or completion or
abandonment of the construction work, whichever
occurs first.
ARTICLE 2. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
ARTICLE 3. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
