ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 7 OF THE CITY
CODE BY IMPOSING A TWO MONTH MORATORIUM ON
THE ISSUANCE OF BUILDING PERMITS FOR
BILLBOARDS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. Section 7-28 of the Code of Ordinances of the
City of Cape Girardeau, is hereby amended by adding a new
subsection 20 to read as follows:
"(20) Chapter 31, "Special Construction"
is amended by adding a new Section 3102.15
to read as follows:
SECTION 3102.15 BILLBOARDS
3102.15.1 All other provisions of this Code
to the contrary notwithstanding,
it shall be unlawful to
construct, enlarge or alter any
billboard, as defined in Section
30-2 of the City Code, without
first obtaining a building
permit.
3102.15.2 No building permit shall be
issued to construct, enlarge or
alter any billboard from August
19, 2002 until October 22, 2002.
SECTION 2. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
Section 3. The City Council intends to consider an
ordinance to further regulate the construction of billboards.
The Council determines that such action is necessary to preserve
the public peace, property, health, safety and morals. The
Council further determines that while the imposition of further
billboard regulations are under consideration it is highly
probable that numerous applications for billboard building
permits will be filed. Accordingly, it is hereby declared an
emergency exists as provided for in Section 3.15 of the City
Charter for the City of Cape Girardeau, Missouri in that the
immediate preservation of the public peace, property, health,
safety and morals requires that a two month moratorium be placed
on the issuance of building permits for billboards.
Section 4. This ordinance shall be in full force and
effect from and after its passage and approval.
