AN ORDINANCE LEVING A SPECIAL ASSESSMENT FOR
TIMBERLANE DRIVE FROM KAGE ROAD TO THE DEAD
END; CAPAHA TRAIL FROM THE END OF EXISTING

INCH ASPHALTIC PAVEMENT PROGRAM OF THE
TRANSPORTATION FUND, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI, AND AUTHORIZING THE
ISSUANCE OF SPECIAL TAX BILLS THEREFOR
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That the work of repairing and resurfacing
Timberlane Drive from Kage Road to the Dead End; Capaha Trail from
the end of existing pavement to Garden Lane; Hill Street from
Johnson Street to the Dead End; Beaudean Lane from College Street
to South of Elm Street; Beaudean Lane from Linden Street to Hickory
Street; Engram Street from Highland Drive to the Dead End; Terry
Lane from Kingsway Drive to Joanne Street; and Johnson Street from
Rand Street to Riverview Drive, Known as the 1999 4 Inch Asphaltic
Pavement Program of the Transportation Fund, with hot mix asphaltic
concrete, four (4) inches thick and eighteen to twenty (18-20) feet
in width, including grading, excavating, rebuilding shoulders,
compacting, adjusting manholes and all necessary appurtenances
thereto, all as shown on the plans and specifications for said
improvement, in the City of Cape Girardeau, Missouri, authorized by
Ordinance No. 2510 entitled, "AN ORDINANCE REAFFIRMING THE ACTION
OF THE CITY COUNCIL DECLARING IT NECESSARY TO IMPROVE, PROVIDING
FOR THE IMPROVEMENT, DIRECTING THE CITY MANAGER TO ENTER INTO A
CONTRACT TO DO THE WORK AND PROVIDING FOR THE MANNER OF PAYMENT OF
THE WORK, OF TIMBERLANE DRIVE FROM KAGE ROAD TO THE DEAD END;
CAPAHA TRAIL FROM THE END OF EXISTING PAVEMENT TO GARDEN LANE; HILL
STREET FROM JOHNSON STREET TO THE DEAD END; BEAUDEAN LANE FROM
COLLEGE STREET TO SOUTH OF ELM STREET; BEAUDEAN LANE FROM LINDEN
STREET TO HICKORY STREET; ENGRAM STREET FROM HIGHLAND DRIVE TO THE

accepted.
ARTICLE 2. That there be and there hereby is levied a special
assessment against the lots and tracts of land fronting and
abutting Timberlane Drive from Kage Road to the Dead End; Capaha
Trail from the end of existing pavement to Garden Lane; Hill Street
from Johnson Street to the Dead End; Beaudean Lane from College
Street to South of Elm Street; Beaudean Lane from Linden Street to
Hickory Street; Engram Street from Highland Drive to the Dead End,
Terry Lane from Kingsway Drive to Joanne Street; and Johnson Street
from Rand Street to Riverview Drive to pay the cost of repairing
and resurfacing Timberlane Drive from Kage Road to the Dead End;
Capaha Trail from the end of existing pavement to Garden Lane; Hill
Street from Johnson Street to the Dead End; Beaudean Lane from
College Street to South of Elm Street; Beaudean Lane from Linden
Street to Hickory Street; Engram Street from Highland Drive to the
Dead End; Terry Lane from Kingsway Drive to Joanne Street; and
Johnson Street from Rand Street to Riverview Drive the distance
improved and assessed as follows:

ARTICLE 3. These Special Tax Bills bear interest at a rate of
four and eighty-eight one hundredths per cent (4.88%), per annum,
and shall become due and payable sixty (60) days after the date of
issue thereof, unless a proper request for installment payments is
filed with the City Clerk within that sixty (60) day period. Every
Special Tax Bill shall be a lien against the lot or tract or parcel

of land described in said Special Tax Bill for a period of ten (10)
years after date of issue, unless sooner paid, except in the case
of Special Tax Bills payable in installments, the lien of which
shall not expire until one (1) year after the date of maturity of
the last annual installment, and except in any case where it
becomes necessary to bring suit to enforce the lien of any Special
Tax Bill, the lien of which shall continue until the expiration of
the litigation.
All Special Tax Bills payable in installments shall be due and
payable in ten (10) annual installments. One tenth (1/10th) of the
amount assessed in these Special Tax Bills shall be payable in the
first year after the date of issuance, plus interest at a rate of
four and eighty-eight one hundredths per cent (4.88%-), payable
annually, on the outstanding balance of the tax bill and one tenth
(1/10th) of the tax bill plus interest as specified above shall be
payable on each successive anniversary thereof for nine (9) years
thereafter. If any installment including principal and interest,
is not paid when due, then all of the remaining installments shall,
at the option of the holder of these tax bills, become immediately
due and payable, provided that the owner of the property shall have
the privilege of paying the whole of any tax bill in full at any
time, or on any annual installment payment date or of paying in
full one (1) or more of the remaining installments not of maturity
date. In all actions to enforce any Special Tax Bill, the Court
shall fix and allow a reasonable Attorney fee, not to exceed ten
(10 ) percent of the amount of said tax bill, to the plaintiff's
attorney for his services in the prosecution of said action, and
shall tax the same as costs in the proceeding.
ARTICLE 4. The Final Report of the City Engineer is attached
hereto and all the information contained therein is hereby approved
and incorporated herein by reference.
ARTICLE 5. The City Clerk hereby is authorized to make out and
issue tax bills against the lots and tracts of land herein
described for the amounts assessed against them in evidence of such
assessment and payable to the City of Cape Girardeau, Missouri. The
said tax bills shall be signed by the City Clerk under the seal of
the City, and duly filed for record in the Office of the City
Clerk.
ARTICLE 6. This ordinance shall be in full force and effect
ten days after its passage and approval.

Engineer's Final Report on the 1999 4"Asphalt Pavement Program
To the City Manager
Of the City of Cape Girardeau, Missouri
Dear Sir:
I hereby report that the improvements made under the 1999 4" Asphalt Pavement Program have
been completed. The contractor, Apex Paving Company, Inc., completed the work in accordance with
the plans, specifications, contract and ordinances adopted by the City Council therefor. This program
consisted of improving portions of the following streets: Johnson Streetfrom Rand Street to Hill Street
for a distance of 241 feet and a width of 20 feet; Hill Street from Johnson Street northerly to a dead end
for a distance of 648 feet and a width of 20 feet; Elm Street from Benton Street to Beaudean Lane for
a distance of 210 feet and a width of 20 feet; Beaudean Lane from Elm Street to Highway 74 for a
distance of 1,273 feet and a variable width; Beaudean Lane from Hickory Street to a point 80 feet North
of Linden Street for a length of 510 feet and a variable width; Hickory Street from Benton Street to
Beaudean Lane for a distance of 211 feet and a width of 20 feet;Engram Street from Highland Drive to
a dead end for a distance of 713 feet and a width of 16 feet;Capaha Trail from the existing pavement
to Garden Lane for a distance of 896 feet and a width of 16 feet;Timberlane Drive from Kage Road to
a dead end for a distance of 357 feet and a width of 17 feet; andTerry Lane.from Kingsway Street to
Joanne Street for a distance of 504 feet of 4 inch pavement and 270 feet of 2 inch overlay, both with a
width of 20 feet. Change Order No. 1 added an alley, between Middle Street and Fountain Street, from
North Street South to the existing pavement for a distance of 126 feet and a width of 12 feet, and grouted
rip -rap on.Country Club Drive from Vincent Avenue eastward for 143 feet. Change Order No. 2 added
the overlay of Capaha Tail from Cape Rock Drive to the end -of the existing pavement for a distance of
930 feet and a width of 20 feet. Change Order No. 3 added the removal and replacement of driveway
pipes at -Terry Lane from Kingsway Drive to Joanne Street. The original contract time was sixty (60)
calendar days for substantial completion and seventy-five (75) calendar days for final completion, which
were September 4, 1999 and September 19, 1999 respectfully.. Twenty-seven days were added to the
contract in consideration of extra work added to the contract. The contractor successfully met these
deadlines
