BILL NO. 02-23 ORDINANCE NO. Qq -7 I
AN ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY FOR
THE COLLEGE STREET EXTENSION PROJECT FROM WEST END
BOULEVARD TO LOUIS STREET
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Staff is authorized and directed to acquire certain real
property and property rights for easements and right-of-way to construct street
improvements and stormwater collection, detention and drainage to extend College
Street from West End Boulevard to Louis Street. The City Staff is hereby authorized
and directed to negotiate in good faith with the owners of the property in an effort to
reach an agreement for such acquisition and if negotiations fail, proceed to acquire
the needed properties through the exercise of the City's powers of Eminent Domain.
ARTICLE 2. The properties designated for acquisition for this project are as
follows:
TRACT A.
Sheila Kirk and Gloria Oakleaf
Permanent Drainage Easement
Part of Lot 16 Block 7 of Koch's Subdivision recorded in Plat Book 2 Page 53 in Outlot 56
in U.S.P. Survey N0. 2199, Township 30 North, Range 13 East, in the City and County of
Cape Girardeau, State of Missouri, to -wit:
All that part of said Lot 16, being a strip of land 20 feet in width lying along the east
property line of said Lot as recorded in Deed Book 998 at page 323 in the Cape Girardeau
County Recorders Office, a distance of 43.05 feet more or less, and containing 861 square
feet, more or less.
Temporary Construction Easement
Part of Lot 16 Block 7 of Koch's Subdivision recorded in Plat Book 2 Page 53 in Outlot 56
in U.S.P. Survey N0. 2199, Township 30 North, Range 13 East, in the City and County of
Cape Girardeau, State of Missouri, to -wit:
All that part of said Lot 16, being a strip of land 5 feet in width lying along the south
property line of said Lot 16 as recorded in Deed Book 998 at page 323 in the Cape
Girardeau County Recorders Office, also being the north right-of-way line of College
Street, a distance of 175.50 feet more or less, and containing 878 square feet, more or
less.
TRACT B.
William Loos and Mary Loos
Part of Lot 1 Block 4 of Brink's Subdivision recorded in Plat Book 5 Page 7 in Outlot 56 in
U.S.P. Survey N0. 2199, Township 30 North, Range 13 East, in the City and County of
Cape Girardeau, State of Missouri, to -wit:
All that part of said Lot 1, being a strip of land 10 feet in width lying along the north
property line of said Lot as recorded in Deed Book 168 at page 424 in the Cape Girardeau
County Recorders Office, also being the south right-of-way line of College Street, a
distance of 65.00 feet more or less, and containing 650 square feet, more or less.
TRACT C.
Glen F. Amelunke and Barbara A. Amelunke
Part of Lot 2 Block 4 of Brink's Subdivision recorded in Plat Book 5 Page 7 in Outlot 56 in
U.S.P. Survey N0. 2199, Township 30 North, Range 13 East, in the City and County of
Cape Girardeau, State of Missouri, to -wit:
All that part of said Lot 2, being a strip of land 10 feet in width lying along the north
property line of said Lot as recorded in Deed Book 208 at page 703 in the Cape Girardeau
County Recorders Office, also being the south right-of-way line of College Street, a
distance of 58.00 feet more or less, and containing 580 square feet, more or less.

Gregory A. Lowes and Cindy T. Lowes
Part of Lot 3 Block 4 of Brink's Subdivision recorded in Plat Book 5 Page 7 in Outlot 56 in
U.S.P. Survey N0. 2199, Township 30 North, Range 13 East, in the City and County of
Cape Girardeau, State of Missouri, to -wit:
All that part of said Lot 3, being a strip of land 10 feet in width lying along the north
property line of said Lot as recorded in Deed Book 734 at page 410 in the Cape Girardeau
County Recorders Office, also being the south right-of-way line of College Street, a
distance of 60.50 feet more or less, and containing 605 square feet, more or less.

property line of said Lots 4 and 5 as recorded in Deed Book 810 at page 915 in the Cape
Girardeau County Recorders Office, a distance of 125.00 feet more or less, and containing
2500 square feet, more or less.

property line of said Lots 7 and 8 as recorded in Deed Book 762 at page 555 in the Cape
Girardeau County Recorders Office, a distance of 96.50 feet more or less, and containing
1930 square feet, more or less.

less, except for 50.00 feet in a tract conveyed to Missouri Utilities Company by deed
recorded in Book 175 at Page 77, and containing 4500 square feet, more or less.

Beginning at the southeast corner of a tract of land recorded in Deed Book 170 at page 3
in the Cape Girardeau County Recorders Office thence north along the east property line
of said tract, also being the west right-of-way line of Missouri Street as described in Deed
Book 151 at Page 546 a distance of 191.00 feet; thence leaving said east Ione N 640542-9"

A strip of land 25 feet wide lying 10 feet east of and parallel to the east right-of-way
line of Minnesota Street, also being the west property line of a tract of land recorded
in Book 170 at Page 3 in the Cape Girardeau County Recorder's Office, beginning at
the southwest corner of said tract thence north a distance of 1029.4 feet and
containing 10,294 square feet, more or less.
Temporary Construction Easement NO. 2
Part of Outlot 43 in U.S.P. Survey N0. 2199, Township 30 North, Range 13 East, in the
City and County of Cape Girardeau, State of Missouri, to -wit:
Commence at the southeast corner of a tract of land recorded in Deed Book 170 at
page 3 in the Cape Girardeau County Recorders Office thence north along the east
property line of said tract, also being the west right-of-way line of Missouri Street as
described in Deed Book 151 at Page 546 a distance of 191.90 feet to the point of
beginning; thence continue along said east property line a distance of 297.18 feet;
thence leaving said east property line S 35'25'17" W a distance of 287.92 feet;
thence S 64054'29" E a distance of 141.53 feet to the point of beginning and
containing 0.46 acres more or less.

Temporary Construction Easement
PART OF OUTLOT 44 IN U.S.P. SURVEY N0. 2199, TOWNSHIP 30 NORTH, RANGE 13
EAST, IN THE CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, TO -
WIT:
A strip of land 9 feet in width lying along the north property line of a tract of land
recorded in Deed Book 175 at page 77 in the Cape Girardeau County Recorders Office,
also being the south right-of-way line of College Street a distance of 50.00 feet more or
less, and containing 450 square feet
ARTICLE 3. The Council of the City of Cape Girardeau, Missouri, hereby finds
and declares that the acquisition of the above described properties is for a public use
and that such acquisition is within the scope of the authority or power of the City of
Cape Girardeau, Missouri, and that the acquisition of the properties is reasonable and
necessary for public use in order to provide for street improvements and stormwater
management needs of the community.

ARTICLE 4. This ordinance shall be in full force and effect ten days after its
passage and approval.
