HomeMy WebLinkAboutORD.2967.02-04-2002BILL NO. 02-17 ORDINANCE NO. }'1 _, AN ORDINANCE VACATING THE CITY'S INTEREST IN A UTILITY EASEMENT IN KINDER LYNWOOD HILLS ESTATES SUBDIVISION NUMBER ONE, IN THE CITY OF CAPE GIRARDEAU, MISSOURI POOKII S21: uu 80 WHEREAS, the City Council has received a request from property owners that the City vacate a utility easement in Kinder Lynwood Hills Estates Subdivision Number One, and more particularly described in Section 1 hereof; and WHEREAS, the City Council set the date of January 22, 2002, for a public hearing on this request; and WHEREAS, at least ten (10) days notice of the time and place of this hearing was published in a newspaper of general circulation in the City; and WHEREAS, a public hearing was held on January 22, 2002, at which all interested parties were afforded the opportunity to speak in favor of or in opposition to the proposed utility easement vacation; and WHEREAS, the City Council has determined that the utility easement in question is not necessary or needed for the purposes for which it was dedicated and established; and WHEREAS, it is in the public interest that the utility easement be vacated; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City's interest in a utility easement on the following described real estate: A fifteen (15) foot utility easement that is one hundred fifty (150) feet long, more particularly described as follows: The easterly fifteen (15) feet of Lot Number Two (2) in Kinder Lynwood Hills Estates Subdivision Number One in the City and County of Cape Girardeau, Missouri. is hereby vacated. sooKIIS4 pp,,E 81 ARTICLE 2.
