AN ORDINANCE ENACTING A NEW SECTION 17-196
OF THE CITY CODE, RELATING TO DELIVERY OR
CONCEALMENT OF CONTRABAND ARTICLES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. There is hereby enacted
Article VIII, of the Code of Ordinances
Girardeau, Missouri, entitled "Deliver
Contraband Articles", in words and figures,
a new Section 17-196,

to read as follows:
Sec. 17-196. Delivery or Concealment of Contraband
Articles
(1) No person shall knowingly deliver, attempt to
deliver, have in such person's possession,
deposit or conceal in or about the premises of
the municipal jail:
a. Any controlled substance as that term is
defined by Section 17-231, except upon the
written prescription of a licensed
physician, dentist, or veterinarian;
b. Any tobacco products of any kind or any
spirituous or malt liquor;
C. Any article or item of personal property
which a prisoner is prohibited by law or
rule made pursuant to Missouri Revised
Statutes Section 221.060 from receiving or
possession, except as herein provided;
d. Any gun, knife, weapon, or other article or
item of personal property that may be used
in such manner as to endanger the safety or
security of the institution or as to
endanger the life or limb of any prisoner or
employee thereof.
(2) The chief operating officer of the jail may deny
visitation privileges to or refer to the city
prosecuting attorney for prosecution any person
who knowingly delivers, attempt to deliver, has
in such person's possession, deposits or conceals
in or about the premises of such jail or facility
any personal item which is prohibited by rule or
regulation of such jail or facility. Such rules
or regulations, including a list of personal
items allowed in the jail or facility, shall be
prominently posted for viewing both inside and
outside such jail or facility in an area
accessible to any visitor, and shall be made
available to any person requesting such rule or
regulation.

ARTICLE 2. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
ARTICLE 3. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and the sections of this Code may
be renumbered to accomplish such intention.
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
