ORDINANCE NO.
AN ORDINANCE ACCEPTING A SANITARY SEWER AND
WATERLINE EASEMENT FROM D & D CAPE
INVESTMENTS, L.P., FOR SANITARY SEWERS AND A
WATERLINE LOCATED AT THE SOUTHEAST CORNER OF
THE ROUTE 74 AND MT. AUBURN ROAD INTERSECTION
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Sanitary Sewer and Waterline Easement, executed by D & D
Cape Investments, L.P., a Missouri Limited Partnership, conveying
to the City of Cape Girardeau, Missouri, a Sanitary Sewer and
Waterline Easement for sanitary sewers and a waterline located at
the southeast corner of the Route 74 and Mt. Auburn Road
intersection, more particularly described as follows, to -wit:
A PART OF UNITED STATES PRIVATE SURVEY NO. 174, TOWNSHIP
30 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN,
CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING at an 80d nail at the intersection of the east
line of a tract of land as recorded in the land records
of the County Recorder's Office in book no. 422 at page
no. 697; and the southerly right of way line of Missouri
State Route 74 (relocated), said point being 121.83 feet
southerly of and normal to the centerline of Route 74,
station 37+40.36; Thence along the easterly line of said
tract of land S 070 17' 10" W, 68.54 feet; Thence leaving
said easterly line, N 820 01125" W, 30.46 feet; Thence S
49° 48' 28" W, 215.64 feet to the beginning of a non -
tangent curve concave to the southwest having a central
angle of 280 58' 26" and a radius of 655.00 feet from
which point a radial line bears, S 520 29' 20" W; Thence
along said curve in a southeasterly direction, 331.23
feet; Thence S 800 35' 17" W, 15.00 feet to a point on
the easterly right of way of Mount Auburn Road said point
being the beginning of a non -tangent curve concave to the
southwest having a central angle of 290 30' 52" and a
radius of 640.00 feet from which point a radial line
bears, S 810 29' 00" W; Thence along said curve and right
of way in a northwesterly direction, 329.68 feet; Thence
continuing along said right of way, N 380 01' 52" W,
18.51 feet to a point on the southerly right of way of
Missouri State Route 74; Thence along said southerly
right of way the following courses and distances: N 490
48128" E, 180.13 feet; Thence N 500 27141" E, 120.40 feet
to the POINT of BEGINNING, containing 0.29 acres more or
less.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
