AN ORDINANCE ACCEPTING SANITARY SEWER
EASEMENTS FROM D & D CAPE INVESTMENTS, L.P.
AND ARMSTRONG HERITAGE, INC., FOR SANITARY
SEWERS LOCATED SOUTH OF ROUTE 74 BETWEEN I-55
AND MT. AUBURN ROAD
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Sanitary Sewer Easement, executed by D & D Cape
Investments, L.P., a Missouri Limited Partnership, conveying to the
City of Cape Girardeau, Missouri, a Sanitary Sewer Easement for
sanitary sewers located South of Route 74 between I-55 and Mt.
Auburn Road, more particularly described as follows, to -wit:
A PART OF UNITED STATES PRIVATE SURVEY NO. 174, TOWNSHIP
30 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN,
CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING at an 80d nail at the intersection of the east
line of a tract of land as recorded in the land records
of the County Recorder's Office in book no. 422 at page
no. 697; and the southerly right of way line of Missouri
State Route 74 (relocated), said point being 121.83 feet
southerly of and normal to the centerline of Route 74,
station 37+40.36; Thence along the easterly line of said
tract of land S 070 17' 10" W, 2031.77 feet to the
southeast comer of said tract; Thence leaving said east
line and along the south line of said tract, N 830 44148"
W, 217.65 feet to the TRUE POINT of BEGINNING:
Thence continuing along said south line, N 830 44148" W,
21.01 feet to a point on the easterly right of way of
Interstate Route 55; Thence leaving the aforesaid south
line and along said right of way the following courses
and distances: N 110 35' 07" W, 207.47 feet; Thence N
21° 17' 50" W, 240.00 feet; Thence N 040 45' 58" W,
228.44 feet; Thence N 080 50' 20" E, 148.81 feet; Thence
leaving said right of way, S 850 04' 25" E, 368.54 feet;
Thence N 070 17' 10" E, 392.69 feet; Thence N 040 49153"
E, 340.24 feet to a point on the westerly right of way of
Mount Auburn Road, said point being the beginning of a
non -tangent curve concave to the southwest having a
central angle of 181 42' 12" and a radius of 560.00 feet
from which point a radial line bears, S 780 34' 58" W;
Thence along said curve and right of way in a
southeasterly and southwesterly direction, 182.80 feet;
Thence continuing along said right of way, S 070 17' 10"
W, 567.44 feet; Thence leaving said right of way, N 85°
04125" W, 363.88 feet; Thence S 08050115" W, 132.74 feet;
Thence S 040 47' 59" E, 223.52 feet; Thence S 210 17' 50"
E, 238.05 feet; Thence S 110 35' 07" E, 215.96 feet to
the TRUE POINT of BEGINNING, containing 0.77 acre more or
less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Sanitary Sewer Easement, executed by Armstrong Heritage,
Inc., a Missouri corporation, conveying to the City of Cape
Girardeau, Missouri, a Sanitary Sewer Easement for sanitary sewers
located South of Route 74 between I-55 and Mt. Auburn Road, more
particularly described as follows, to -wit:

30 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN,
CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, BEING
MORE PARTICULARLY DESCRIBED AS FOLLOWS:
A STRIP OF LAND BEING 20.00 FEET WIDE, LYING 10.00 ALONG
EACH SIDE OF THE FOLLOWING DESCRIBED EASEMENT CENTERLINE.
COMMENCING at an 80d nail at the intersection of the east
line of a tract of land as recorded in the land records of
the County Recorder's Office in book no. 422 at page no.
697; and the southerly right of way line of Missouri State
Route 74 (relocated), said point being 121.83 feet
southerly of and normal to the centerline of Route 74,
station 37+40.36; Thence along the easterly line of said
tract of land S 070 17' 10" W, 2031.77 feet to the
southeast corner of said tract; Thence leaving said
easterly line and along the south line of said tract, N 830

Thence leaving said south line, S 210 17150" E, 1044.63
feet; Thence S 840 35142" E, 314.44 feet; Thence S 051
25'44" W, 175.76 feet to a point on the southerly line of

a tract of land as recorded in book no. 807 at page no. 521
and there terminating.
The side lines of said easement being prolonged and
shortened to terminate with the southerly line of a tract
of land recorded in book no. 422 at page no. 697 and with
the southerly line of a tract of land recorded in book 807
at page no. 521.

A STRIP OF LAND BEING 20.00 FEET WIDE, LYING 10.00 ALONG
EACH SIDE OF THE FOLLOWING DESCRIBED EASEMENT CENTERLINE.

The side lines of said easement being prolonged and
shortened to terminate with the westerly right of way of
Mount Auburn Road.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
