HomeMy WebLinkAboutORD.2950.11-19-2001BILL NO. 2001-229 ORDINANCE NO. j` r AN ORDINANCE ESTABLISHING THE BOUNDARIES OF LATERAL SEWER DISTRICT NO. 14 -FF -1, A SUBDIVISION OF TRUNK SEWER DISTRICT NO. 14, APPROVING THE PLANS AND AUTHORIZING THE CONSTRUCTION OF A SYSTEM OF SANITARY LATERAL SEWERS IN LATERAL SEWER DISTRICT NO. 14 -FF -1, UNDER A PRIVATE CONTRACT SUBJECT TO CERTAIN PROVISIONS, IN THE CITY OF CAPE GIRARDEAU, MISSOURI BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. That the boundaries of Lateral Sewer District No. 14 -FF -1, a subdivision of Trunk Sewer District No. 14 in the City of Cape Girardeau, Missouri, shall be as follows: Lateral Sewer District 14 -FF -1 A Part of Trunk Sewer District 14 A PART OF UNITED STATES PRIVATE SURVEY NO. 174, TOWNSHIP 30 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN, CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: Commence at an 80D nail at the intersection of the east line of a tract of land as recorded in the land records of the County Recorder's office in book no. 422 at page no. 697 and the south right of way line of Missouri State Route 74 (relocated), said point being 121.83 feet southerly of and normal to the centerline of Route 74, Station 37+40.36; thence along the south right of way line of said Missouri State Route 74, South 50027141" West, 120.40 feet; thence South 49048'28" West, 260.10 feet; thence South 49008130" West, 405.49 feet; thence South 28042125" West, 108.79 feet to the intersection of the south right of way line of said Missouri State Route 74 and the east right of way line of Interstate 55; thence along said east right of way line of Interstate 55, South 14037'11" East, 206.40 feet; thence South O1047159" East, 221.71 feet; thence South 08050'20" West, 308.73 feet; thence South 04045'58" East, 228.44 feet; thence South 21017150" East, 240.00 feet; thence South 11035' 07" East, 207.47 feet to a point being the southwest corner of said tract of land recorded in book no. 422 at page no. 697; thence continue along the east right of way line of Interstate 55 in a southeasterly direction to the southwest corner of a tract of land as recorded in the land records of the County Recorder's office in book no. 807 at page no. 521; thence along the south property line of said tract, 615.0 feet more or less to the northwest corner of United State Private Survey (USPS) 173; thence along the north line of USPS 173 to the intersection of said north line and the extended east line of said tract as recorded in book no. 807 at page no. 521; thence northerly along said east line, 800.0 feet more or less, to the southeast corner of a tract of land as recorded in the land records of the County Recorder's office in book no. 184 at page no. 319, said point also being on the west line of Silver Springs Road; thence continue northerly along the west line of Silver Springs Road to the southeast corner of a tract of land as recorded in the land records of the County Recorder's office in book no. 646 at page no. 347; thence continue northerly along the east line of said tract, 600.0 feet more or less, to a point on the west right of way line of Silver Springs Road (relocated) as recorded in the land records of the County Recorder's office in book no. 908 at page no. 880; thence westerly to a point 60 feet west of Relocated Silver Springs Road centerline station 23+75; thence northerly 73.77 feet to a point which is 60.0 feet west of centerline P.T. station 23+01.23of said relocated Silver Springs Road; thence northwesterly 155.0 feet more or less to a point 60.0 feet west of centerline station 21+00.00 of said relocated Silver Springs Road; thence northwesterly 85.0 feet more or less to a point 65.0 feet west of centerline station 19+91.65 of said relocated Silver Springs Road; thence northwesterly 30.0 feet more or less to a point 61.0 feet west of centerline station 19+63.00 of said relocated Silver Springs Road, said point also being the southeast corner of a tract of land as recorded in the land records of the County Recorder's office in book no. 1140 at page no. 762; thence along the east line of said tract, North 52027'41" West, 81.81 feet; thence North 40007133" West, 166.41 feet; thence North 24024126" West, 270.14 feet; thence North 12019'13" West, 100.49 feet to a point being the intersection of the south right of way line of Missouri State Route 74 and the west right of way line of Relocated Silver Springs Road; thence along said south right of way line of Missouri State Route 74, North 88039'03" West, 42.60 feet; thence South 53052141" West, 300.17 feet; thence South 50027141" West, 259.73 feet to the point of beginning. 2. ARTICLE 2. That the plans for the construction of a system of sanitary lateral sewers to serve Lateral Sewer District No. 14 -FF - 1, a copy of which is on file in the office of the City Clerk, are hereby approved and ordered filed. ARTICLE 3. That the owners of lands in said Lateral Sewer District No. 14 -FF -1 are hereby granted permission to construct said system of sanitary lateral sewers in Lateral Sewer District No. 14 -FF -1 and to connect same to existing sewers in Trunk Sewer District No. 14, subject to the following provisions: 1. That proper authority will be secured to proceed from the Missouri Clean Water Commission. 2. That all permanent easements for said sewers on private property are made to the City of Cape Girardeau, Missouri, prior to execution of a contract for the work of construction of said sewers. 3. That all City Ordinances, Standard Specifications of the City and State laws applicable to this project will be observed in all respects. 4. That the quality of the work and materials be inspected by the agents of the City engineer of the said City, and that cost of said inspections be paid to said City following the completion of the work.
