ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 2 OF
THE CITY CODE RELATING TO CITY
ADVISORY BOARDS AND COMMISSIONS
TERM LIMITS AND ATTENDANCE POLICY
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 2-98(b) of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Appointment of
members; term limits", reading as follows:
Sec. 2-98. Appointment of members; term limits.
(b) Except for alternate members, no person shall be
appointed to the same board or commission for more
than two (2) consecutive full terms, beginning
with terms that commenced on or after January 6,
1996. This term limitation shall not apply if the
city council makes a finding that special
expertise is required and there are no other
qualified applicants.
sS'`_hereby repealed in its entirety, and a new Section 2-98(b)
entitled "Appointment of members; term limits" is hereby enacted
in lieu thereof, in words and figures, to read as follows:
Sec. 2-98. Appointment of members; term limits.
(b) Except for alternate members, no person may serve
more than two (2) consecutive full terms on the
same board or commission, beginning with terms
that commenced on or after January 6, 1996. This
term limitation shall not apply if the city
council makes a finding that special expertise is
required and there are no other qualified
applicants. If a member is reappointed to succeed
himself to serve the balance of his or her
unexpired term, the combined periods shall
constitute service of a full term within the
meaning of this subsection as if no break in
service had occurred.
ARTICLE 2. Section 2-101(a) of the Code of Ordinances of
the City of Cape Girardeau, Missouri, entitled "Attendance of
members of boards and commissions required", reading as follows:
Sec. 2-101. Attendance of members of boards and
commissions required.
(a) If any board or commission member misses three (3)
consecutive meetings of the board or commission,
or four (4) meetings in any twelve (12) continuous
months, their position on such board or commission
shall automatically be deemed vacant and a
replacement shall be named as provided. In
computing attendance, no allowances shall be made
for any excuses.

ARTICLE 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
ARTICLE 4. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and the sections of this Code may
be renumbered to accomplish such intention.
ARTICLE 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
