ORDINANCE NO
AN ORDINANCE AMENDING THE
BOUNDARIES OF WARDS 1, 2, 3, 4, 5
AND 6 OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, IN RESPONSE
TO THE YEAR 2000 DECENNIAL CENSUS
WHEREAS, the 2000 decennial census shows an increase in the
population of the City of Cape Girardeau, Missouri, and a change
in the distribution of City residents; and
WHEREAS, Article III of the City Charter, Section 3.01(b),
states that the City Council shall, in conjunction with the
receipt of each decennial census, make such adjustments in the
boundaries of the wards of the City as are necessary to comply
with law.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Ordinance No. 1355, Part 2, is hereby amended by
repealing the legal description of the boundaries of "Ward 1" in
its entirety and enacting a new legal description of the
boundaries of "Ward 111, in words and figures, to read as
follows, to -wit:
Ward 1
Beginning at a point where the centerline of Henderson
Avenue intersects with the centerline of Normal
Avenue; thence in an easterly direction with the
centerline of Normal Avenue to its intersection with
the centerline of Sprigg Street; thence in a southerly
direction with the centerline of Sprigg Street to its
intersection with the centerline of North Street;
thence in an easterly direction with the centerline of
North Street to its intersection with the centerline
of Park Drive; thence in an easterly direction with
the centerline of Park Drive and its straight
projection thereof to the Eastern City limits
effective September 4, 2001; thence in a northeasterly
direction along the City limits line to its
intersection with the northern City limits of the City
of Cape Girardeau effective September 4, 2001; thence
in a northwesterly and westerly direction along the
City limits line to its intersection with the
centerline of Old Sprigg Street Road; thence in a
southerly direction with the centerline of Old Sprigg
Street Road to its intersection with the centerline of
Bertling Street; thence in a westerly direction with
the centerline of Bertling Street to its intersection
with the centerline of West End Boulevard; thence in a
southerly direction with the centerline of West End
Boulevard to its intersection with the centerline of
Wayne Street; thence in a westerly direction with the
centerline of Wayne Street to its intersection with
the centerline of Perry Avenue; thence in a southerly
direction with the centerline of Perry Avenue to its
intersection with the centerline of New Madrid Street;
thence in an easterly direction with the centerline of
New Madrid Street to its intersection with the
centerline of Henderson Avenue; thence in a southerly
direction with the centerline of Henderson Avenue to
its intersection with the centerline of Normal Avenue,
being the point of beginning of the Ward herein
described.
ARTICLE 2. Ordinance No. 1355, Part 2, is hereby amended by

its entirety and enacting a new legal description of the
boundaries of "Ward 2", in words and figures, to read as
follows, to -wit:

thence in an easterly direction with the centerline of

ARTICLE 4. Ordinance No. 1355, Part 2, is hereby amended by

its entirety and enacting a new legal description of the
boundaries of "Ward 411, in words and figures, to read as
follows, to -wit:

ARTICLE 5. Ordinance No. 1355, Part 2, is hereby amended by

its entirety and enacting a new legal description of the
boundaries of "Ward 511, in words and figures, to read as
follows, to -wit:

ARTICLE 7. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
ARTICLE & It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and the sections of this Code may
be renumbered to accomplish such intention.
ARTICLE 9. This ordinance shall be in full force and effect
ten days after its passage and approval.
