AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF THE NORTH
SIDE OF LEXINGTON AVENUE, BETWEEN PERRYVILLE
ROAD AND STEVEN DRIVE, CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI FROM R-1 TO R-4
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-1 Single -Family Dwelling
District to R-4, Multiple Dwelling District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday,
August 6, 2001; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-1, Single -Family Dwelling District to R-4, Multiple Dwelling
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-1, Single -Family Dwelling District to R-4,
Multiple Dwelling District, for the following described property:
Part of USP Survey No. 2198 part of S.E. Quarter of
Section 24, Township 31 North, Range 13 East of the Fifth
Principle Meridian. Commence at the S.E. corner of
Section 24; North 85 degree 38' West along and with the
South line of Section 24, a distance of 594.0 feet to the
Southwest corner of Northfield First Subdivision; thence
continue North 84 degrees 41' West along and with said
South line, a distance of 1146.39 feet for a place of
beginning on the North right of way line of Lexington
Avenue at 40 feet opposite and mean to station 69 +
29.40; thence Easterly along said right of way on a curve
to the left having a radius of 555.0 feet, a distance of
17.11 feet (chord bears South 85 degrees 34' East, 17.11
feet); thence South 86 degrees 27' East, along said right
of way, 317.9 feet; thence on a curve to the left having
a radius of 20.00 feet, a distance of 31.04 feet (chord
bears North 49 degrees 05' East, 28.02 feet); thence
North 4 degrees 37" East along the West right of way line
of Steven Drive, 106.90 feet to the South line of
Woodland Hills Subdivision; thence North 83 degrees to
54' 48" West along the South line of said Subdivision,
609.48 feet to the East right of way line of Perryville
Road; thence along said right of way with the following:
South 20 degrees 28' 21" West, 127.26 feet; thence South
26 degrees 41' East, 25.5 feet and South 55 degrees 32'
East, 29.1 feet to said North right of way line of
Lexington Avenue, thence South 84 degrees 41' East, 162.2
feet to the place of beginning, in the City and County of
Cape Girardeau, Missouri
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of R-4, Multiple
Dwelling District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
