ORDINANCE NO.
AN ORDINANCE AMENDING THE BOUNDARIES OF
LATERAL SEWER DISTRICT NO. 14-1-D-5, A
SUBDIVISION OF TRUNK SEWER DISTRICT NO. 14-1-
D, APPROVING THE PLANS AND AUTHORIZING THE
CONSTRUCTION OF A SYSTEM OF SANITARY LATERAL
SEWERS IN LATERAL SEWER DISTRICT NO. 14-1-D-5,
UNDER A PRIVATE CONTRACT SUBJECT TO CERTAIN
PROVISIONS, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE1. The boundaries of Lateral Sewer District No. 14-1-
D-5, a subdivision of Trunk Sewer District No. 14-1-D, as
established in Ordinance No. 2216, passed and adopted August 18,
1997, are hereby amended to read as follows:
Commence at the southeast corner of a tract of land
recorded in the land records of the County Recorder's
Office in book no. 551 at page no. 631, said point being
on the north line of Woodland hills Estates Subdivision
as recorded in plat book no. 10 at page no. 5; thence
along the north line of said subdivision, North 890 43'
19" West, 672.45 feet to the northeast corner of lot no.
13 of said subdivision said point being the southeast
corner of a tract of land as recorded in book no. 588 at
page no. 988; thence along the east line of said tract,
North 000 16' 41" East, 75.00 feet to the northeast
corner of said tract; thence along the north line of said
tract and its prolongation, North 890 43' 19" West,
675.58 feet; thence North 000 16' 41" East, 300.00 feet
to a point; thence North 000 00' 00" West, 993.68 feet to
the Northeast corner of the Northeast Quarter of Section
23; thence South 890 28' 09" East, 556.50 feet; thence
South 000 37' 10" West, 110.08 feet; thence South 890 43'
19" East, 205.10 feet; thence North 000 38' 51" East,
60.04 feet; thence South 890 27' 23" East, 581.21 feet to
a point, thence North 000 10' 20" West, 50.12 feet to an
Iron Pipe, thence North 880 57' 04" East, 241.36 feet,
thence along the arc of a non tangent curve concave to
the southwest, having a radius of 543.00 feet, a distance
of 286.07 feet, thence South 080 33' 28" West, 195.37
feet, thence South 070 36' 37" West, 138.30 feet, thence
South 010 22' 21" West, 138.22 feet, thence South 190 52'
46" East, 162.37 feet to a point on the West right of way
line of Perryville Road; thence North 820 47' 01" West,
368.87 feet, thence South 000 10' 20" East, 539.83 feet
to the point of beginning.
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Lateral Sewer District No. 14-1-D-
5, a copy of which is on file in the office of the City Clerk, have
heretofore been approved and ordered filed.
ARTICLE 3. That the owners of lands in said Lateral Sewer
District No. 14-1-D-5 are hereby granted permission to construct
said system of sanitary lateral sewers in Lateral Sewer District
No. 14-1-D-5 and to connect same to existing sewers in Trunk Sewer
District No. 14-1-D, subject to the following provisions.
1. That proper authority will be secured to proceed from the
Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City Engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work.
ARTICLE 4. This ordinance shall be
ten days after its passage and approval.
