ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 61 NORTH
CLARK AVENUE, CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI FROM R-4 TO M-1
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-4, Multiple Dwelling District to
M-1, Light Industrial District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday,
July 2, 2001; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-4, Multiple Dwelling District to M-1, Light Industrial
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-4, Multiple Dwelling District to M-1, Light
Industrial District, for the following described property:
Part of Block Three (3) and a portion of vacated Whitener
Street of Harris Subdivision, a subdivision of Lot 8 and
12 and part of Lots 5, 9 and 12 of Sturdivants
Subdivision of Out Lots 58, 59, 81 and part of 60 in
U.S.P. Survey No. 2199 in the City of Cape Girardeau,
Missouri, described as follows:
Commence at the northeast corner of Lot 1, Block 2 of
Harris Subdivision same point being the intersection of
the South line of Themis Street and the West line of
Clark Avenue; thence South 80 20' West along the west
line of Clark Avenue 383.5 feet for a corner; thence
North 810 40' West 5 feet for a point of beginning;
thence continue onward North 810 40' West 295 feet to the
East line of Spring Avenue extended for a corner; thence
South 80 20' West along the East line of Spring Avenue
extended 19.0 feet more or less for a corner on the North
line of the Missouri Pacific Railroad; thence South 540
57' East 330.25 feet along the north line of the Missouri
Pacific Railroad to corner of the West line of Clark
Avenue; thence North 80 20' East 170.0 feet along the
West line of Clark Avenue to the point of beginning.
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of M-1, Light
Industrial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
