AN ORDINANCE VACATING THE CITY'S INTEREST IN A
UTILITY POLE EASEMENT AT 1721 CRESTWOOD, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI

WHEREAS, the City Council has received a request that the City
vacate a utility pole easement at 1721 Crestwood, and more
particularly described in Section 1 hereof; and
WHEREAS, the City Council set the date of July 2, 2001, for a
public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on July 2, 2001, at which
all interested parties were afforded the opportunity to speak in
favor of or in opposition to the proposed utility pole easement
vacation; and
WHEREAS, the City Council has determined that the utility pole
easement in question is not necessary or needed for the purposes
for which it was dedicated and established; and
WHEREAS, it is in the public interest that the utility pole
easement be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in a utility pole easement on
the following described real estate:
Part of Lots Six (6) and Seven (7) in Block Seven (7) of
Oak Hills Subdivision in the City and County of Cape
Girardeau, Missouri, as recorded in Plat Book 6 at Page
8, more particularly described as follows:
Commence at the Southwest corner of Lot 7; thence North
25012'00" East, 4.0 feet along the West property line;
thence South 64048'00" East, 116.0 feet to a point;
thence South 25012100" West, 8.0 feet; thence North
64048100" West, 116.0 feet to the West line of Lot 6;
thence North 25012100" East, 4.0 feet along said West
line to the Point of Beginning.

is hereby vacated.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.

sealed in behalf of said City by authority of its City Council and
acknowledged said instrument to be the free act and deed of said
City.
