AN ORDINANCE ACCEPTING A SPECIAL WARRANTY DEED FROM
UNION ELECTRIC COMPANY, A MISSOURI CORPORATION D/B/A
AMEREN UE, FOR RIGHT-OF-WAY FOR THE WALKER BRANCH
PORTION OF THE CAPE LA CROIX CREEK/WALKER BRANCH FLOOD
CONTROL PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a Special
Warranty Deed executed by Union Electric Company, a Missouri Corporation, d/b/a
AmerenUE, conveying to the City of Cape Girardeau, Missouri, a Special Warranty
Deed for right-of-way for the Walker Branch portion of the Cape La Croix
Creek/Walker Branch Flood Control Project, more particularly described as follows, to -
wit:
Tract I: Part of Out Lot 75, U.S.P. Survey 2199 and of Fractional
Section 30, Township 31 North, Range 14 East, in the City and
County of Cape Girardeau, Missouri, described as follows to wit:
Commence at the northeast corner of said Out Lot 75; thence South
08 degrees 43 minutes West, with the east line of said Out Lot 75,
1 1 .5 feet to a point on the southwest line of the Perryville Road, 30
feet out normally from the center line of the concrete slab on said
Perryville Road; thence North 29 degrees 58 minutes West, parallel
with and 30 feet out normally from the center line of said slab, and
with the southwest line of said Perryville Road, 44.9 feet for a
beginning corner of the land hereby conveyed; thence continue North
29 degrees 58 minutes West, with the southwest line of said
Perryville Road, 75.0 feet to the point where said southwest line
intersects the southeast line of Cape Rock Road; thence South 75
degrees 39 minutes West, with said southeast line of Cape Rock
Road, 8.4 feet; thence South 35 degrees 25 minutes West 83.8 feet;
thence South 35 degrees 39 minutes East, 50.7 feet; thence North 54
degrees 21 minutes East, 80.0 feet to the beginning corner.
Tract II: Lot 1 in Block 3 of Drury's Second Subdivision in the City
and County of Cape Girardeau, Missouri, as shown by plat recorded in
Plat Book 6, Page 29.
ARTICLE 2. This ordinance shall be in full force and effect ten days after its
passage and approval.
