AN ORDINANCE ACCEPTING PERMANENT EASEMENTS FROM
JIM MAUER, MANAGING PARTNER OF JJP INVESTMENTS
AND THE BOARD OF REGENTS FOR SOUTHEAST MISSOURI
STATE UNIVERSITY FOR LIMITED MAINTENANCE OF A
STORMWATER BOX CULVERT EXTENSION
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI,
AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a Permanent
Easement for limited maintenance of a stormwater box culvert extension executed by Jim
Mauer, Managing Partner of JJP Investments on property located at 1126 N. Sprigg Street,
more particularly described as follows, to -wit:
A PART OF LOT 11 AND LOT 12 OF BLOCK 4 OF THE MARBLE CITY
HEIGHTS ADDITION TO THE CITY AND COUNTY OF CAPE GIRARDEAU,
STATE OF MISSOURI, DESCRIBED AS FOLLOWS:
Beginning at the Southwest corner of said Lot 12; Thence N 07045'29" E,
7.05 feet along the west line of said Lot 12; Thence leaving said west line, S
84055'46" E, 67.96 feet; Thence N 88100'00" E, 41.83 feet; Thence N
85-56'50" E, 12.03 feet; Thence S 88000'03" E, 41.85 feet; Thence N
88°48'26" E, 20.17 feet to a point on the east line of said lot 12; Thence S
07045'57" W, 20.25 feet along said east line; Thence leaving said east line,
S 88048'26" W, 17.58 feet; Thence N 88100'03" W, 41.35 feet; Thence S
85°56'50" W, 2.49 feet to point on the south line of said Lot 12; Thence N
82000'00" W, 6.54 feet along said south line to the northeast corner of a
tract of land recorded in the land records of the County Recorder's Office in
book no. 918 at page no. 865; Thence along the east line of said tract, S
07048'39" W, 1.40 feet; Thence leaving said east line, S 85056'50" W,
2.16 feet; Thence S 88000'00" W, 43.42 feet; Thence N 84155'46" W,
5.09 feet to a point on the west line of the said tract recorded in book no.
918 at page no. 865; Thence along the west line of said tract, N 07049'06"
E, 9.65 feet to the northwest corner of said tract, said point also being on
the south line of the aforementioned Lot 12 of Block 4 of the Marble City
Heights Addition; Thence along said south line, N 82100'00" W, 64.98 feet
to the point of beginning; containing 0.067 acres.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby accepts a Permanent
Easement for limited maintenance of a stormwater box culvert extension executed by Jim
Mauer, Managing Partner of JJP Investments on property located at 1126 N. Sprigg Street,
more particularly described as follows, to -wit:
A PART OF LOT 12 AND LOT 13 OF BLOCK 4 OF THE MARBLE CITY
HEIGHTS ADDITION TO THE CITY AND COUNTY OF CAPE GIRARDEAU,
STATE OF MISSOURI, DESCRIBED AS FOLLOWS:
Beginning at the Southwest corner of said Lot 12; Thence N 07145'29" E,
50.55 feet along the west lines of said Lot 12 and said Lot 13; Thence
leaving said west line, S 07010'59" E, 52.38 feet to the south line of said
Lot 12; Thence N 82°00'00" W, 13.50 feet along said south line to the
point of beginning; containing 341 square feet.
ARTICLE 3. The City of Cape Girardeau, Missouri, hereby accepts a Permanent
Easement for limited maintenance of a stormwater box culvert extension executed by the
Board of Regents for Southeast Missouri State University on property located at the northeast
corner of N. Sprigg Street and Emerald Street, more particularly described as follows, to -wit:
A PART OF LOT 11 OF BLOCK 4 OF THE MARBLE CITY HEIGHTS ADDITION
TO THE CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
DESCRIBED AS FOLLOWS:
Beginning at the Northwest corner of said Lot 11; Thence S 82100'00" E,
64.98 feet along the north line of said Lot 11 to the Northeast corner of a
tract of land recorded in the land records of the County Recorder's Office in
book no. 455 at page no. 94; Thence S 07049'06" W, 9.65 feet along the
east line of said tract; Thence leaving said east line, N 84055'46" W, 65.04
feet to a point on the west line of the aforementioned Lot 1 1; Thence N
07045'29" E, 12.97 feet to the point of beginning; containing 735 square
feet.
ARTICLE 4. This ordinance shall be in full force and effect ten days after its passage
and approval.
