AN ORDINANCE ACCEPTING A TEMPORARY
CONSTRUCTION EASEMENT FROM TIMBERLINE
INTERNATIONAL FOREST PRODUCTS, INC. FOR ACCESS
TO CONSTRUCT A RAIL SPUR IN THE GREATER CAPE
GIRARDEAU INDUSTRIAL PARK
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a
Temporary Construction Easement for access to construct a rail spur, executed by
Timberline International Forest Products, Inc. on property located in the Greater Cape
Girardeau Industrial Park in the County of Cape Girardeau, State of Missouri, more
particularly described as follows, to -wit:
A PART OF THE SOUTHWEST QUARTER OF SECTION 27, TOWNSHIP 30
NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN, COUNTY OF
CAPE GIRARDEAU, STATE OF MISSOURI, BEING MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
Commencing at a Concrete Monument at the Southeast corner of said
Section 27, thence S88o57'55"W, 2834.49 feet along the South line of said
Section 27 to a 1/2" Iron Pin (Set), being the southeast corner of a tract of
land recorded in the land records of the Cape Girardeau County Recorder's
Office in Book 897 at Page 770, said point being the point of beginning;
thence N 0037'30"W 2659.93 feet to a point on the south right-of-way line
of Missouri State Route AB, locally known as Nash Road, said point being
the northeast corner of a tract of land recorded in the land records of the
Cape Girardeau County Recorder's Office in Book 785 at Page 797; thence
N 8922'30"E, 80.00 feet along said right-of-way line to the northwest
corner of a tract of land recorded in the land records of the Cape Girardeau
County Recorder's Office in Book 661 at Page 620; thence SOOo37'30"E,
2659.36 feet along the west line of said tract, and its prolongation to a point
on the south line of said Section 27; thence S88o57'55"W, 80.00 feet to
the point of beginning.
ARTICLE 2. This ordinance shall be in full force and effect ten days after its
passage and approval.
