AN ORDINANCE VACATING THE CITY'S INTEREST IN A
PORTION OF HELENA STREET RIGHT-OF-WAY, IN THE
CITY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, the City Council has received a request from property
owners that the City vacate a portion of Helena Street right-of-way
from Broadway south for an approximate distance of 265 feet, and
more particularly described in Section 1 hereof; and
WHEREAS, the City Council set the date of May 7, 2001, for a
public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on May 7, 2001, at which
all interested parties were afforded the opportunity to speak in
favor of or in opposition to the proposed Helena Street right-of-
way vacation; and
WHEREAS, the City Council has determined that the right-of-way
in question is not necessary or needed for the purposes for which
it was dedicated and established; and
WHEREAS, it is in the public interest that the Helena Street
right-of-way be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE1. The City's interest in the Helena Street right-of-
way on the following described real estate:
A tract of land being that part of Outlot 60 in Township
31 North, Range 14 East in the City and County of Cape
Girardeau, State of Missouri, more particularly described
as follows:
Commence at the Northeast corner of Lot 7 in Block No. 3
of Oak Park Subdivision, a subdivision on file in the
Land Records of said county in plat book 4 on page 6,
said point being on the South right of way line of
Broadway; thence along said South right of way line,
North 83059102" East, 50.24 feet to the Northwest corner
of Lot 7 in Block No. 2 of Oak Park Subdivision, said
point being on the East right of way line Helena Avenue;
thence along said East right of way line, South 00021147"
East, 268.30 feet; thence leaving said East right of way
line, North 89057139" West, 50.00 feet to a point on the
West right of way line of Helena Avenue; thence along
said West right of way line, North 00021147" West, 263.00
feet to the point of beginning.
is hereby vacated.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
