AN ORDINANCE ACCEPTING A WATER LINE EASEMENT
FROM DRURY SOUTHWEST, INC. AND A GENERAL
WARRANTY DEED FROM DSW DEVELOPMENT CORPORATION
FOR A PORTION OF RICHMOND DRIVE, ALL FOR
IMPROVEMENTS TO SERVE CAPE WEST MOBILE HOME
PARK
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Water Line Easement, executed by Drury Southwest, Inc.,
a Missouri Corporation, conveying to the City of Cape Girardeau,
Missouri, a Water Line Easement for improvements to serve Cape West
Mobile Home Park, more particularly described as follows, to -wit:
WATERLINE EASEMENT NO. 1:
A PART OF UNITED STATES PRIVATE SURVEY NO. 175, TOWNSHIP
30 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN,
COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
A strip of land being 15 feet wide lying 7.50 feet along
each side of the following described easement centerline.
Commencing at a ?" iron pin being the northwest corner of
lot 1 of Cape West Eighth Subdivision as recorded in the
land records of the County Recorder's Office in plat book
no. 19 at page no. 100; Thence along the west line of
said subdivision, N 270 10' 54" W, 561.73 feet to the
TRUE POINT OF BEGINNING, said point being the beginning
of a non -tangent curve concave to the northwest having a
central angle of 090 06' 07" and a radius of 326.00 feet
from which point a radial line bears N 110 08' 12" W;
Thence leaving said west line and along said curve in a
southwesterly direction, 51.79 feet; Thence S 840 58' 21"
W, 28.24 feet; Thence S 620 49' 06" W, 70.42 feet; Thence
N 270 10' 54" W, 71.15 feet; Thence S 620 49' 06" W,
26.85 feet; Thence N 850 01' 35" W, 354.44 feet; Thence
S 57° 11' 03" W, 14.88 feet to the beginning of a curve
concave to the northeast having a central angle of 750
13' 17" and a radius of 106.64 feet; Thence along said
curve in a southwesterly and northwesterly direction,
140.00 feet; Thence N 470 35' 40" W, 15.67 feet; Thence
N 850 01' 35" W, 401.39 feet; Thence N 060 54' 52" E,
290.17 feet and there terminating.
WATER LINE EASEMENT NO. 2
A PART OF UNITED STATES PRIVATE SURVEY NO. 175, TOWNSHIP

COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:

W, 820.63 feet and there terminating.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a General Warranty Deed, executed by DSW Development
Corporation, conveying to the City of Cape Girardeau, Missouri, a
General Warranty Deed for a portion of Richmond Drive, for
improvements to serve Cape West Mobile Home Park, more particularly
described as follows, to -wit:

30 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN,
COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
Commencing at a 1/2" iron pin being the northwest corner
of lot 1 of Cape West Eighth Subdivision as recorded in
the land records of the County Recorder's Office in plat
book no. 19 at page no. 100; Thence along the west line
of said subdivision, N 270 10' 54" W, 557.57 feet to the
TRUE POINT OF BEGINNING, said point being the beginning
of a nontangent curve concave to the northwest having a
central angle of 030 35' 34" and a radius of 330.00 feet
from which point a radial line bears N 110 20' 11" W;
Thence along said curve in a northeasterly direction,
20.69 feet; Thence N 750 04' 15" E, 88.13 feet to the
beginning of a curve concave to the northwest having a
central angle of 120 15' 10" and a radius of 530.00 feet;
Thence along said curve in a northeasterly direction,
113.34 feet; Thence N 620 49' 06" E, 146.33 feet to the
beginning of a curve concave to the southwest having a
central angle of 900 00' 00" and a radius of 20.00 feet;
Thence along said curve in a northeasterly and
southeasterly direction, 31.42 feet to a point on the
westerly right of way line of Kell Farm Drive; Thence
along said right of way, N 270 10' 54" W, 80.00 feet to
a point on the northerly right of way of Richmond Drive;
Thence leaving said right of way S 620 49' 06" W, 166.33
feet to the beginning of a curve concave to the northwest
having a central angle of 120 15' 10" and a radius of
470.00 feet; Thence along said curve in a southwesterly
direction, 100.51 feet; Thence S 750 04' 15" W, 88.13
feet to the beginning of a curve concave to the northwest
having a central angle of 070 14' 31" and a radius of
270.00 feet; Thence along said curve in a southwesterly
direction, 34.13 feet to a point on the west line of the
aforesaid Cape West Eighth Subdivision; Thence along said
west line, S 270 10' 54" E, 62.94 feet to the TRUE POINT
OF BEGINNING, containing 0.54 acres more or less.

ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
