AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 200
BELLEVUE STREET, CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI FROM R-4 AND M-2 TO R-4
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-4, Multiple Dwelling District
and M-2, Heavy Industrial District to R-4, Multiple Dwelling
District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday,
March 5, 2001; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-4, Multiple Dwelling District and M-2, Heavy Industrial
District to R-4, Multiple Dwelling District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City of
Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-4, Multiple Dwelling District and M-2, Heavy
Industrial District to R-4, Multiple Dwelling District, for the
following described property:
Part of Lot No. 4 in Range "F" and parts of vacated
Bellevue Street and vacated Spanish Street, in the City
and County of Cape Girardeau, Missouri, described as
follows: Commence at the Northeast corner of said Lot 4
in Range "F"; thence North 81 degrees 56' West, along the
North line of said lot, 180.00 feet to the place of
beginning; thence South 08 degrees 00' west, 80.00 feet;
thence South 81 degrees 56' East, 180.00 feet to a point
in the West right of way line of North Main Street;
thence with said line, South 08 degrees 00' West, 182.05
feet to a point in the centerline of Bellevue Street;
thence with said centerline, North 81 degrees 56' West,
214.33 feet; thence North 08 degrees 00' East, 30.00 feet
to the intersection of the East line of Spanish Street
and the North line of Bellevue Street; thence North 81
degrees 56' West, with the North line of Bellevue Street,
50.00 feet; thence North 08 degrees 00' East, 232.05
feet; thence South 81 degrees 56' East, 84.33 feet to the
place of beginning.
All as shown on Plat of Survey by Koehler Land Surveying,
dated September 29, 1998, Drawing #98-04835.
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of R-4, Multiple
Dwelling District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
