AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF THE
NORTHEAST QUADRANT OF INTERSTATE 55 AND
HIGHWAY 34/61, CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI FROM R-1 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-1 Single -Family Dwelling
District to C-2, General Commercial District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday,
March 5, 2001; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-1, Single -Family Dwelling District to C-2, General
Commercial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City of
Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-1, Single -Family Dwelling District to C-2,
General Commercial District, for the following described property:
All of that part of the Northwest Quarter of Section 22,
and all of that Part of the Southwest Quarter of Section
15, and all of that port of the Southeast Quarter of the
Southeast Quarter of Section 18, and all of that part of
the Northeast Quarter of the Northeast Quarter of Section
21, all in the Township 31 North, Range 13 East of the
Fifth Principal Meridian, in the County of Cape
Girardeau, State of Missouri, More particularly described
as follows:
Commence of the Southeast Corner of United States Private
Survey Number 788, marked by a sandstone as described
hereon, thence West, 557.01 feet, thence South 0025120"
East, 385.97 feet, to the place of beginning; thence
South 89052143" West, 648.74 feet, to a point on the East
right of way line of Interstate 1551, thence with said
right of way line South 15048119" East, 2.15 feet, thence
South 21017152" East, 1082.00 feet, to a point 130 feet
normal and opposite to Interstate 155' Station 1014+50,
thence South 32036128" East, 1147.28 feet, to a point 355
feet normal and opposite to interstate 155' station
1025+75, thence South 55016101" East, 564.04 feet, to a
point 80 feet normal and opposite to the West bound lane
of Missouri Highway 161' station 903+00, thence South
58055105" East, 594.95 feet, to a point 80 feet normal
and opposite to the West bound lane of Missouri Highway
161' station 908+95.6, thence North 10026119" East,
820.34 feet, thence North 00054105" West, 50.00 feet,
thence South 89005155" West, 12.00 feet, thence North
00°54105" West, 120.00 feet, thence South 89005155" West,
120.00 feet, thence North 00054105" West, 952.65 feet,
thence North 42008150" West, 409.38 feet, thence North
O1°36150" West, 345.20 feet, thence North 89001140" West,
1050.78 feet, thence North 00025120" West, 12.90 feet, to
the place of beginning, excepting all parts within
Missouri State Highway Right of Way and the Right of way
of Limbaugh lone, and except a 50 foot right of way
granted to the Cape Special Road District for access, and
leaving a total of 71.72 acres, more or less.
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of C-2, General
Commercial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be
ten days after its passage and 11app oval.
