AN ORDINANCE ACCEPTING PERMANENT EASEMENTS
AND TEMPORARY CONSTRUCTION EASEMENTS FROM
VARIOUS PROPERTY OWNERS FOR THE CAPE ROCK
DRIVE 20" WATER MAIN EXTENSION PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri hearby accepts a Temporary
Construction Easement executed by Barbara J. Frenzel and Edward Frenzel conveying to the City of
Cape Girardeau, Missouri an easement for the Cape Rock Drive 20" Water Main Extension project,
more particularly described as follows, to -wit:
THAT PART OF LOTS NO. 1 & 2, IN BLOCK H OF CAPE ROCK HILLS
SUBDIVISION, A SUBDIVISION ON FILE IN THE LAND RECORDS OF CAPE
GIRARDEAU COUNTY, IN THE CITY AND COUNTY OF CAPE GIRARDEAU,
STATE OF MISSOURI, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCE at the Southwest corner of Lot no. 1 of Block H, said point being at the
centerline of Rand Street; thence along said centerline of Rand Street, North 62°46'58"
East, 35.30 feet, to the point of beginning; thence leaving said centerline of Rand Street
South 82°42'08" East 604.78 feet; thence South 83°27'08" East 101.89 feet; thence
South 83'15'44" East 278.27 feet; thence North 10'03'10" West 26.11 feet; thence
North 83°15'44" West 270.77 feet; thence North 83°27'08" West 101.77 feet; thence
North 82°42'08" West 568.26 feet to the centerline of Rand Street; thence along said
centerline of Rand Street South 62°46'58" West 44.12 feet to the point of beginning and
containing 24,072 square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri hereby accepts a Permanent
Waterline Easement executed by Barbara J. Frenzel and Edward M Frenzel conveying to the
City of Cape Girardeau, Missouri an easement for the Cape Rock Drive 20" Water Main
Extension Project, more particularly described as follows, to -wit:
THAT PART OF LOT 1 & 2, BLOCK H OF CAPE ROCK HILLS
SUBDIVISION, A SUBDIVISION ON FILE IN THE LAND RECORDS OF
CAPE GIRARDEAU COUNTY, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, STATE OF MISSOURI, MORE PARTICULARLY DESCRIBED
AS FOLLOWS:
BEGIN at the southwest corner of Lot 1, Block H, said point being at the
centerline of Rand Street; thence leaving said centerline of Rand Street, South

South 83°25'08" East 191.31 feet; thence North 10'03'10" West 20.02 feet;

ARTICLE 3. The City of Cape Girardeau, Missouri hearby accepts a Temporary
Construction Easement executed by Mid South Steel Products, Inc., conveying to the City of Cape
Girardeau, Missouri an easement for the Cape Rock Drive 20" Water Main Extension project, more
particularly described as follows, to -wit:
THAT PART OF PART OF U.S. SURVEY 2199, SECTION 33,
TOWNSHIP 31 NORTH, RANGE 14 EAST, ON FILE IN THE LAND
RECORDS OF CAPE GIRARDEAU COUN'T'Y, IN THE CITY AND
COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCE at the Southwest corner of Riverside Boulevard Right of Way
line; thence North 82°51'08" West, 31.89 feet to the point of beginning;
thence continue North 82151'08" West 33.19 feet; thence South 33°59'13"
East 92.82 feet to a point on the north Right of Way line of Burlington
Northern Railroad; thence along said Right of Way of Burlington Northern
Railroad North 560 00'47" East 25.00 feet; thence leaving said Right of Way
line of Burlington Northern Railroad North 33°59'13" West 70.98 feet to the
point of beginning and containing 2,047 square feet, more or less.
ARTICLE 4. The City of Cape Girardeau, Missouri hearby accepts a Permanent
Easement executed by Mid South Steel Products, Inc., conveying to the City of Cape Girardeau,
Missouri an easement for the Cape Rock Drive 20" Water Main Extension project, more particularly
described as follows, to -wit:
THAT PART OF PART OF U.S. SURVEY 2199, SECTION 33,
TOWNSHIP 31 NORTH, RANGE 14 EAST, ON FILE IN THE LAND
RECORDS OF CAPE GIRARDEAU COUNTY, IN THE CITY AND
COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCE at the southwest corner of Riverside Boulevard Right of Way;
thence North 82051' 08" West, 5.34 feet to the point of beginning; thence
North 82°51'08" West, 26.55 feet; thence south 33°59'13" East 70.98 feet to
a point on the north Right of Way line of Burlington Northern Railroad;
thence along said north Right of Way line of Burlington Northern Railroad
North 56°00'47" East, 81.27 feet to the intersection of the north Right of
Way line of Burlington Northern Railroad and the south Right of Way line of
Riverside Boulevard; thence along said Right of Way line of Riverside

Easement executed by Jeff Hutson, Attorney -in -Fact for Jackie L. Hutson Revocable Living Trust,
conveying to the City of Cape Girardeau, Missouri an easement for the Cape Rock Drive 20" Water
Main Extension project, more particularly described as follows, to -wit:
THAT PART OF LOT NO. 9, BLOCK H OF CAPE ROCK HILLS
SUBDIVISION, A SUBDIVISION ON FILE IN THE LAND RECORDS
OF CAPE GIRARDEAU COUNTY, IN THE CITY AND COUNTY OF
CAPE GIRARDEAU, STATE OF MISSOURI, MORE PARTICULARLY
DESCRIBED AS FOLLOWS:

Drive 20" Water Main Extension project, more particularly described as follows, to -wit:

DESCRIBED AS FOLLOWS:
