AN ORDINANCE VACATING THE CITY'S INTEREST IN A
UTILITY EASEMENT IN BROOKSHIRE ESTATES FOURTH
SUBDIVISION, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI

WHEREAS, the City Council has received a request from property
owners that the City vacate a utility easement in Brookshire
Estates Fourth Subdivision, and more particularly described in
Section 1 hereof; and
WHEREAS, the City Council set the date of February 5, 2001,
for a public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on February 5, 2001, at
which all interested parties were afforded the opportunity to speak
in favor of or in opposition to the proposed utility easement
vacation; and
WHEREAS, the City Council has determined that the utility
easement in question is not necessary or needed for the purposes
for which it was dedicated and established; and
WHEREAS, it is in the public interest that the utility
easement be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in a utility easement on the
following described real estate:
A part of the Southeast Quarter of the Southwest Quarter,
Section 19, Township 31 North, Range 14 East more
particularly described as follows:
Begin at the Northeast corner of Lot 2 of Brookshire
Estates Fourth Subdivision; thence South 89042100"
West, 140.70 feet along the north line of said Lot 2 to
the point of beginning; thence continue along said north
line, South 89042100" West, 10.00 feet to a point;
thence leaving said north line, South 00004100" West,
115.54 feet to a point; thence South 90000100" East,
10.00 feet to a point; thence North 00004100" East,
115.59 feet to the point of beginning.
is hereby vacated.

ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.

City.
