AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT WITH THE MISSOURI
HIGHWAYS AND TRANSPORTATION COMMISSION, FOR
THE MAINTENANCE OF TRAFFIC SIGNALS AT THE
INTERSECTION OF SPRIGG STREET AND MORGAN OAK
STREET
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City
of Cape Girardeau, Missouri, is hereby authorized to execute a
Signal Maintenance Agreement with the Missouri Highways and
Transportation Commission for the maintenance of traffic signals
at the intersection of Sprigg Street and Morgan Oak Street. A
copy of said Agreement is attached to this Ordinance and made a
part hereof.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.

SIGNAL MAINTENANCE AGREEMENT
Whereas, on the 31 S` day of March, 1997, the City of Cape Girardeau (City) and The
Missouri Highways and Transportation Commission (Commission) entered into a Supplementary
Urban Agreement for the exchange and transfer of certain streets between them and;
Whereas, as a part of said Supplementary Urban Agreement, certain previously executed
maintenance agreement regarding, among others, Sprigg and Morgan Oak Streets were to remain
in effect until the new Bill Emerson Memorial Bridge is open to traffic and;
Whereas, the completion of said bridge has been delayed and the City in furtherance of
its traffic control plan has by permit from Commission gone ahead and installed new traffic
control equipment at the intersection of Sprigg and Morgan Oak.
That the parties and each of them do hereby agree that City shall maintain such
traffic control equipment without the need for further permit under the terms of said permit and
application marked and attached as Exhibits A and B and incorporated hereto by reference.
2. That this Agreement is the same as is referenced in said Exhibits and shall stay in
effect until such time as the Bill Emerson Bridge is open to traffic at which time this Agreement
shall expire and the terms of the Supplementary Urban Agreement becomes operative.
3. Specifically the items City is agreeing to maintain are:
1. 4 posts and mast arms including signal heads (one at each quadrant).
2. 4 pull boxes (one at each quadrant).
3. All installed activation loops (when installed).
4. 1 Controller and controller cabinet located in the southwest quadrant.
5. Plus all wiring and needed resurfacing.
4. COMMISSION REPRESENTATIVE: The Commission's chief engineer is
designated as the Commission's representative for the purpose of administering the provisions of
this Agreement.
5. ASSIGMENT: The City shall not assign, transfer or delegate any interest in this
Agreement without the prior written consent of the Commission.
6. LAW OF MISSOURI TO GOVERN: This Agreement shall be construed
according to the laws of the state of Missouri. The City shall comply with all local, state and
federal laws and regulations relating to the performance of the contract.
