AN ORDINANCE AUTHORIZING THE ACQUISITION OF
PERMANENT DRAINAGE EASEMENTS AND TEMPORARY
CONSTRUCTION EASEMENTS FOR THE CAPE MEADOWS
CIRCLE STORM SEWER PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Staff is authorized and directed to acquire certain property
needed for the construction of a storm sewer on Cape Meadows Circle extending down to Big
Bend Road and then south to Green Acres Drive. The City staff is hereby authorized and
directed to accept offers of donation of property needed, make appropriate offers of purchase
to the owners of the properties based on values provided by professional appraisers; to
negotiate with the owners of the property in an effort to reach agreement for the purchase of
the property needed and if the negotiations fail, then to proceed to acquire the needed
properties through the exercise of the City's powers of Eminent Domain. All of the above
actions heretofore taken by City Staff relating to the following tracts are hereby authorized
and ratified by the City Council.
ARTICLE 2. The properties designated for acquisition for this project are as follows:
TRACT 1.
THOMAS AND BETTY ROSS
TEMPORARY CONSTRUCTION EASEMENT
A PART OF THE SOUTHEAST QUARTER OF SECTION 39,
TOWNSHIP 31 NORTH, RANGE 14 EAST OF THE FIFTH PRINCIPAL
MERIDIAN, CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF
MISOURI, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
A PART OF LOT 27 IN THE GREEN ACRES SUBDIVISION OF OUT
LOT 70 U.S.P. SURVEY 2199, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI.
COMMENCE at the southwest corner of said Lot 27 thence northerly,
approximately 220.15' along the West property line of said lot to the North line
of out lot 70, U.S.P. Survey 2199, also being the North property line of said
Lot 27; thence along said North line, 5 feet to a point; thence southerly along

the arc of a curve concave to the west having a radius of 6913.46 feet, a distance
of 192.03 feet to the South line of said Lot 27; thence westerly along said South
line, 5 feet to the point of beginning.

MISSOURI, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
A PART OF LOT 11 IN THE CAPE MEADOWS RESUBDIVISION OF
U.S.P. SURVEY 3091 IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI;
BEGIN at the northwest corner of said lot 11, thence northeast along the
property line of said lot to the right of way line of Cape Meadows Circle,
thence along said right of way to the southeast 10 feet, thence leaving said right
of way, South 61° 08'04" West, approximately 153.45 feet to the east right of
way line of Big Bend Road, thence 10 feet in the northerly direction along said
right of way line to the point of beginning.

Bend Road, thence 30 feet in the northerly direction along the right of way of
Big Bend Road to the point of beginning.

SURVEY 3091 IN THE CITY AND COUNTY OF CAPE GIRARDEAU,

BEGIN at the Southwest corner of said Lot 14, thence north along the right of
way line for Big Bend Road 20 feet, thence leaving said right of way line, South

thence along said right of way line to the south property line of said lot, thence
southwest along said property line to the point of beginning.

BEGIN at the Southwest corner of said Lot 14, thence north along the right of
way line for Big Bend Road 10 feet, thence leaving said right of way line, South

southwest along said property line to the point of beginning.
ARTICLE 3. The Council of the City of Cape Girardeau, Missouri hereby finds and
declares that the acquisition of the above-described properties is for a public use and that such
acquisition is within the scope of the authority or power of the City of Cape Girardeau,
Missouri, and that the acquisition of the properties is reasonable and necessary for public use
in order to provide for the improvements of a public storm sewer.
ARTICLE 4. This ordinance shall be in full force and effect ten days after its passage
and approval.
