AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU, MISSOURI, BY CHANGING THE ZONING OF 2621, 2625 AND 2629 HOPPER ROAD, CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI FROM R-1 TO C-2 WHEREAS, the City Planning and Zoning Commission has recommended that all of the property described in Article 1 of this ordinance should be rezoned from R-1 Single -Family Dwelling District to C-2, General Commercial District; and WHEREAS, Public Notice of such change was given as prescribed in Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, and public hearing was held on Monday, February 5, 2001; and WHEREAS, the City Council of the City of Cape Girardeau, Missouri, has elected to rezone the property described in Article 1 from R-1, Single -Family Dwelling District to C-2, General Commercial District; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby amended to change the zoning from the present R-1, Single -Family Dwelling District to C-2, General Commercial District, for the following described property: ALL THAT PART OF LOT SIX (6) OF PLEASANT ACRES, A SUBDIVISION IN THE CITY OF CAPE GIRARDEAU. MISSOURI. DESCRIBED AS FOLLOWS: COMMENCE AT THE NORTHWEST CORNER OF SAID LOT 6; THENCE SOUTH 86 DEG. EAST WITH THE NORTH LINE OF SAID LOT 6, 20 FEET FOR A BEGINNING CORNER; THENCE CONTINUE SOUTH 86 DEG. EAST WITH THE NORTH LINE OF SAID LOT 6, 60 FEET; THENCE SOUTH 4 DEG. WEST PARALLEL TO THE WEST LINE OF SAID LOT 6, 109 FEET TO THE SOUTH LINE OF SAID LOT 6; THENCE SOUTH 77 DEG. 58' WEST WITH SAID SOUTH LINE, 62.4 FEET; THENCE NORTH 4 DEG. EAST PARALLEL TO THE WEST LINE OF SAID LOT 6, 126.25 FEET TO THE BEGINNING CORNER. All of the East 40 feet of Lot five (5) and all of the West 20 feet of Lot Site (6) of Pleasant Acres, a Subdivision of Lot 1 in Block 4 and part of Lot 9 in Block 4 of Rodney Vista, a Subdivision of Out Lot 79, U.S.P. Survey 2199 in the City of Cape Girardeau, Missouri, described as follows: Begin at the Northeast corner of said Lot 5; thence North 86 deg. West with the North line of said Lot 5, 40 feet; thence South 4 deg. West parallel to the line between said Lots 5 and 6, 143.5 feet to the South line of said Lot 5; thence North 77 deg. 58' East with the South line of said Lots 5 and 6, 62.4 feet: thence North 4 deg. East parallel to the line between r said Lots 5 and 6, 126.25 feet to the North line of said Lot 6; thence North 86 deg. West with the North line of said Lot 6, 20.0 feet to the beginning corner. TRACT I All that part of lots 4 and 5 of Pleasant Acres, a subdivision of Lot 1, Block 4 and a part of Lot 9, Block 4, of Rodney Vista, a Subdivision of Out Lot 79, U.S.P. 2199 in the City of Cape Girardeau, Missouri, described as follows, to wit: Begin at the N. E. corner of said Lot 4, thence N. 860 West with the North line of said Lot 4, 20.01; thence South 40 West, parallel to the line between said lots 4 and 5, 146.3'; thence S. 63.04' E, 21.7' to an eastern corner of said Lot 4; thence N. 77° 58' E. with the south line of said Lot 5, 41.61; thence N. 40 East parallel to the line between said Lots 4 and 5; 143.5' to the North line of said Lot 5; thence N. 86° West with said north line, 40.0' to the beginning corner. Subject to all road right-of-way and easements, if any, over and across said land. TRACT II Lot No. 128 and Lot No. 129 of Hidden Valley Unit No. 3 as recorded in Plat Book 10 at page 28 subject to restrictions of record. Also an undivided interest in the well providing water to the above described property, provided, however, that the lot owner shall not receive water from said well until all connection and tap fees are paid. ARTICLE 2. The City Council hereby finds and declares that the property described in Article 1 hereof is at the present time particularly suitable for the purposes and uses of C-2, General Commercial District, and that such changes authorized hereby are reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties.
