ORDINANCE NO. 2636
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF THE
NORTHEAST CORNER OF INTERSTATE 55 AND STATE
HIGHWAY 74, CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI FROM R-1 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-1 Single -Family Dwelling
District to C-2, General Commercial District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday,
February 5, 2001; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-1, Single -Family Dwelling District to C-2, General
Commercial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City of
Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-1, Single -Family Dwelling District to C-2,
General Commercial District, for the following described property:
DESCRIPTION - 3.94 ACRE TRACT NO. 1

A PART OF UNITED STATES PRIVATE SURVEY NO. 174, TOWNSHIP
30 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN,
CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING at the intersection of the northerly right of
way line of Missouri State Route 74 and the westerly
right of way line of Mount Auburn Road; Thence along the
northerly right of way of Missouri State Route 74 the
following courses and distances:
S 54° 49' 53" W, 2.00 feet; Thence S 520 40' 35" W,
285.02 feet; Thence S 520 40' 32" W, 120.01 feet; Thence
S 850 32' 01" W, 94.70 feet to a point on the easterly
right of way line of Interstate Route 55; Thence leaving
the aforesaid northerly right of way and along said
easterly right of way the following courses and
distances:
N 53° 09' 00" W, 198.96 feet; Thence N 350 08' 36" W,
142.13 feet; Thence leaving said right of way, N 610 59'
12" E, 500.06 feet to a point on the westerly right of
way line of Mount Auburn Road; Thence along said right of
way the following courses and distances:
S 58° 27' 25" E, 61.11 feet to the beginning of a curve
concave to the southwest having a central angle of 20°
21' 43" and a radius of 310.00 feet; Thence along said
curve in a southeasterly and southwesterly direction,
110.17 feet; Thence S 380 05' 42" E, 1.95 feet; Thence S
440 40' 48" W, 2.63 feet; Thence S 380 01' 52" E, 137.10
feet to the POINT OF BEGINNING, containing 3.94 acres
more or less. (171,817.98 square feet)

BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING at the southwest corner of Lot no. 1 of Block
3 of Northview Acres as recorded in the land records of
the County Recorder's Office in plat book no. 5 at page
no. 5, Thence along the south line of said lot, S 830 08'
32" E, 249.18 feet to the southwest corner of Lot no. 7
of Block 4 of said subdivision said point being on the
west line of a tract of land as recorded in book no. 446
at page no. 149; Thence leaving the aforesaid south line
and along the west and south lines of said tract the
following courses and distances:
S 07- 17' 10" W, 150.00 feet; Thence S 830 08' 32" E,
104.42 feet to a point on the northerly right of way line
of Missouri State Route 74, said point being 126.42 feet
northerly of and normal to the centerline of State Route
74, station 38+55.45; Thence leaving the aforesaid south
line and along said right of way line the following

233.98 feet; Thence S 540 08' 12" W, 177.13 feet; to a
point on the easterly right of way of Mount Auburn Road;
Thence leaving said Route 74 right of way and along the
east right of way of Mount Auburn Road, N 380 01' 52" W,
151.30 feet; Thence S 440 40' 48" W, 3.51 feet to the
beginning of a non -tangent curve concave to the southwest
having a central angle of 150 15' 56" and a radius of
390.00 feet from which point a radial line bears, S 500

direction, 103.91 feet; Thence leaving said right of way,
N 54° 08' 12" E, 132.63 feet to a point on the southerly
line of a tract of land as recorded in book no. 526 at
page no. 693; Thence along said southerly line, S 820 26'
35" E, 50.96 feet to the southeast corner of said tract;
Thence along the easterly line of said tract, Thence N
07° 26' 15" E, 168.19 feet to the POINT OF BEGINNING,
containing 2.46 acres more or less. (107,006.69 square
feet)
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of C-2, General
Commercial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
