AN ORDINANCE VACATING THE CITY'S INTEREST IN A
UTILITY EASEMENT IN FIRST PARK WEST
PROFESSIONAL PLAZA, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI

WHEREAS, the City Council has received a request from property
owners that the City vacate a utility easement in First Park West
Professional Plaza, and more particularly described in Section 1
hereof; and
WHEREAS, the City Council set the date of October 9, 2000, for
a public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on October 9, 2000, at
which all interested parties were afforded the opportunity to speak
in favor of or in opposition to the proposed utility easement
vacation; and
WHEREAS, the City Council has determined that the utility
easement in question is not necessary or needed for the purposes
for which it was dedicated and established; and
WHEREAS, it is in the public interest that the utility
easement be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in a utility easement on the
following described real estate:
A Tract of land in First Park West Professional Plaza, a
part of Outlots 82,83, & 84, U.S. Private Survey 2199,
City and County of Cape Girardeau, State of Missouri,
more particularly described as follows:
A 10.0' wide utility easement 5' either side of the
following described line:
Begin at the southeast corner of Lot 5, First Park West
Professional Plaza, said point being on the north line of
Professional Court, thence, north 160.00 feet to the
northeast corner of said lot 5, for the point of
beginning, thence, S 89056' W, 156.60 feet to the
northwest corner of lot 5, said point being on the east
line of Silver Springs Road and there terminating.

ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.

City.
