T? 4 AN ORDINANCE ACCEPTING DEEDS FROM VARIOUS PROPERTY OWNERS FOR THE 1995 FLOOD BUYOUT PROGRAM BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City of Cape Girardeau, Missouri hereby accepts a General Warranty Deed executed by William Joyce and M. Ruth Joyce, husband and wife, conveying to the City of Cape Girardeau, Missouri property for the 1995 Flood Buyout Program, more particularly described as follows, to -wit: All of Lot Numbered Nine (9) in Block Numbered Eight (8) of the Robertson & Gale's Subdivision except for the East 60 feet of Lot 9 in the City of Cape Girardeau, Missouri, as shown by Plat recorded in Plat Book 2 at page 20. ARTICLE 2. The City of Cape Girardeau, Missouri hereby accepts a General Warranty Deed executed by Charles J. Herbst and Judie M. Herbst, husband and wife, conveying to the City of Cape Girardeau, Missouri property for the 1995 Flood Buyout Program, more particularly described as follows, to -wit: All of Lots Numbered Thirteen (13) and Fourteen (14) in Block Numbered Nine (9) of Robertson and Gale's Subdivision in the City of Cape Girardeau, Missouri, as shown by Plat recorded in Plat Book 2 at page 20, land records of Cape Girardeau County, Missouri. ARTICLE 3. The City of Cape Girardeau, Missouri hereby accepts a General Warranty Deed executed by Harold Glenn Cobb, a single person, Jean Ann Schoen and Michael Schoen, her husband, Marilyn Kay Reece and Billy Reece, her husband, and Paula Faye Dover, a single person, as joint tenants and not as tenants in common, conveying to the City of Cape Girardeau, Missouri property for the 1995 Flood Buyout Program, more particularly described as follows, to -wit: All of Lot Three (3) in Block Thirteen (13) of Robertson and Gale's Subdivision to the City of Cape Girardeau, Missouri as recorded in Plat Book 2 at page 20 in the land records of Cape Girardeau County, Missouri. ARTICLE 4. The City of Cape Girardeau, Missouri hereby accepts a General Warranty Deed executed by Otis Phillips and Carrie Lucille Phillips, husband and wife, by and through their Attorney in Fact pursuant to Power of Attorney recorded in Book 999 at page 878 and Book 999 at page 880, conveying to the City of Cape Girardeau, Missouri property for the 1995 Flood Buyout Program, more particularly described as follows, to -wit: Part of the Southwest Quarter of the Southeast Quarter of Section 21, Township 31 North, Range 14 East, described as follows: Commence at a point where the East line of the Southwest Quarter of the Southeast Quarter of said Section 21 intersects the South right-of-way line of Cape Girardeau County Farm -to -Market Route SV; said point being marked by an iron rod, from which a 24 -inch Sweet Gum bears South 59° 58' West, 48 feet; thence North 83° 42' West, 521.2 feet for the point of beginning; thence continue North 83° 42' West, 148.5 feet; thence South 0° 11' East, 81.25 feet more or less, to a corner in Juden Creek; thence with said creek North 73° 2' East, 151.6 feet; thence North 6° 18' East, 20.1 feet to the point of beginning. ARTICLE 5. The City of Cape Girardeau, Missouri hereby accepts a General Warranty Deed executed by Billy Eugene Dietiker and Betty L. Dietiker, husband and wife, Vernon Thomas Dietiker and Magdalena A. Dietiker, husband and wife, Charles Leroy Dietiker, a single person, conveying to the City of Cape Girardeau, Missouri property for the 1995 Flood Buyout Program, more particularly described as follows, to -wit: All of Lot Numbered Twenty -Four (24), Block Numbered Seven (7) of Giboney Houck's Second Subdivision of a part of Out Lot No. Forty -Seven (47) in the City of Cape Girardeau, Missouri. All of 37 1/2 feet off North side of Lot Numbered Twenty -Three (23), Block Numbered Seven (7) in Giboney Houck's Second Subdivision to the City of Cape Girardeau, Missouri as shown on plat filed in Recorder's Office in Jackson, Missouri. (Reference: Deed from Joe Harrold & wife, August 30, 1946 shown in Book 133 at page 465, Recorder's Office in Jackson, Missouri.) EXCEPT: All of the west Seventy-five (75') feet of the North Thirty-seven and one-half (371/2) feet of Lot no. Twenty-three (23) and all of the West Seventy -fie (75') feet of Lot numbered Twenty-four (24), all in Block Numbered Seven (7) of Giboney Houck's Second Subdivision in the City of Cape Girardeau, Missouri, as shown by Plat recorded in Plat Book 1 at page 13, land records of Cape Girardeau County, Missouri. ARTICLE 6. The City of Cape Girardeau, Missouri hereby accepts a General Warranty Deed executed by Thomas L. Steck and Ann M. Steck, husband and wife, and Susan Koepp and Keith Koepp, her husband, conveying to the City of Cape Girardeau, Missouri property for the 1995 Flood Buyout Program, more particularly described as follows, to -wit: All of the East Fifty (50) feet of Lot Three (3) in Block Ten (10) of Robertson and Gale's Subdivision to the City of Cape Girardeau, Missouri in Plat Book 2 at page 20 in the land records of Cape Girardeau County, Missouri.
