AN ORDINANCE ACCEPTING A PERMANENT EASEMENT FROM
RHODES PROPERTIES, L.C. TO OPERATE, MAINTAIN, REDESIGN,
MODIFY AND RECONSTRUCT A PAVED PARKING AREA
PROVIDED FOR PUBLIC USE IN CONJUNCTION WITH THE CITY'S
PARK SYSTEM
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI,
AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a permanent
easement executed by Rhodes Properties, L.C. on property commonly known as 2301
Bloomfield Road, located on the south side of Bloomfield Road along the east side of the
Cape La Croix Creek channel improvements and recreation trail, in the City and County of
Cape Girardeau, State of Missouri, more particularly described as follows, to -wit:
The south 25 feet of a parcel of land being a part of a 7.48 acre tract located
in Out Lots 55, 56 and 87 in the City and County of Cape Girardeau, State of
Missouri, more particularly described to -wit:
Begin at the southwest corner of a tract of land described by deed in Book
1059 at Page 242 in the office of the Cape Girardeau County Recorder; thence
South 83-17'18" East, 75.63 feet; thence North 0642'42" East, 25.00 feet;
thence North 83-17'18" West, 85.14 feet, more or less to a point on the West
property line of said tract; thence South 1405'33" East, 26.75 feet, more or
less to the point of beginning, save and accept that area which is to be used
and maintained by the grantor as a private driveway to a single family
residence.
ARTICLE 2. This ordinance shall be in full force and effect ten days after its passage
and approval.
