AN ORDINANCE AMENDING CHAPTER 22 OF THE CITY
CODE RELATING TO SOLID WASTE FEES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 22-47 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Solid waste
collection fees", reading as follows:
Sec. 22-47. Solid waste collection fees.
(a) Residential customers.
(1) Basic monthly charge. The basic monthly solid
waste collection fee for residential customers
shall be thirteen dollars and thirty cents
($13.30) per month per dwelling unit. Residential
back door service may be provided on a contract
basis subject to fees based on the additional
operating costs associated with providing such
service. Such basic charge shall include the
following services:
a. Up to two (2) thirty-five (35) gallon
containers per week, weight not to exceed
seventy-five (75) pounds per container.
b. Unlimited recycling per week.
C. Spring bulk waste collection program.
d. Fall leaf collection program.
(2) Volume charge. Each additional thirty-five (35)
gallon container beyond two (2) containers per
week shall display an official sticker to be
purchased from the City of Cape Girardeau at one
dollar ($1.00) per sticker. Containers beyond two
(2) per week will not be collected unless said
sticker is prominently displayed.
(b) Commercial customers. The monthly solid waste
collection fee for commercial customers are to be
negotiated between the city and the customer, based on
the size of the container and the amount of usage and
the related operating fees and tipping fees.

hereby enacted in lieu there, in words and figures, to read as
follows:
Sec. 22-47. Solid waste collection fees.
(a) Residential customers.

shall be thirteen dollars and fifty cents ($13.50)
per month per dwelling unit. Residential back door
service may be provided on a contract basis
subject to fees based on the additional operating
costs associated with providing such service. Such
basic charge shall include the following services:
a. Up to two (2) thirty-five (35) gallon
containers per week, weight not to exceed
seventy-five (75) pounds per container.

ARTICLE 2. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
ARTICLE 3. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.

ARTICLE 4. This ordinance shall be in full force and effect
on September 1, 2000.
