ORDINANCE NO. 4:04 1
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 1719 NORTH
KINGSHIGHWAY, CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI FROM R-1 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-1 Single -Family Dwelling
District to C-2, General Commercial District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday, June 5,
2000; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-1 Single -Family Dwelling District to C-2, General Commercial
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City of
Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-1 Single -Family Dwelling District to C-2,
General Commercial District, for the following described property:
ALL THAT PART OF THE SOUTHEAST QUARTER OF THE NORTHWEST
QUARTER, THAT PART OF THE SOUTHWEST QUARTER OF THE
NORTHEAST QUARTER OF FRACTIONAL SECTION 26, TOWNSHIP 31
NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN,
CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
Beginning at a right of way marker in concrete at the
northeast corner of a tract of land as recorded in the
land records of the County Recorder's Office in book no.
982 at page no. 001, said point being on the southerly
right of way line of U.S. Route 61, 61.00 feet southerly
of and normal to the centerline of U.S. 61, station
997+32.80
Thence along the easterly line of said tract South
36000100" West, 455.13 feet to the southeast corner of
said tract; Thence along the southerly line of said tract
the following courses and distances:
North 370 22' 18" West, 82.65 feet; Thence North
77051129" West, 77.43 feet to a 2" iron pin being the
southwest corner of said tract of land; Thence leaving
said southerly line and along the westerly line of said
tract, North 36000100" East, 462.50 feet to a point on
the southerly right of way line of U.S. Route 61; Thence
along said right-of-way line, South 54006147" East,
150.00 feet to the POINT OF BEGINNING, Containing 1.532
acres.
ARTICLE 2. The City Council hereby finds and declares that the
property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of C-2, General
Commercial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
